  • Administrative regulations on registration of Russian citizens (appendix to FMS order No. 288 of September 11, 2012);
  • Law of the Russian Federation No. 5242-I of June 25, 1993 on freedom of movement, choice of place of residence in the Russian Federation;
  • Rules for registration of citizens of the Russian Federation at the place of residence and stay (Resolution of the Government of the Russian Federation No. 713 of July 17, 1995);

It is obvious that citizens of the Russian Federation must register at their place of residence or stay, and the presence of individuals without registration is punishable by an administrative fine of 2 to 3 thousand rubles. (in Moscow and St. Petersburg - from 3 to 5 thousand rubles).

Art. 3 of Law No. 5242-I stipulates that the lack of registration cannot become a reason for the loss of the rights and freedoms of citizens of the Russian Federation. Clause 26.4 of the regulations requires that applicants who apply for a passport be requested to confirm their registration at the place of residence (with the clause “if any”).

There is some duality: citizens are required to have registration, but on the other hand, it may not exist. The question of whether a passport is valid without registration worries many.

The realities of life are full of various conflicts that you should navigate well: different periods are allocated for the registration of different categories of Russian citizens, not to mention stateless persons or foreigners who live in the Russian Federation. In what cases can registration be missing?

How long can you live without registration at your new place of residence?

The sale of an apartment or your own house means the termination of the rights to use them of the previous owner and his family (Article 292 of the Civil Code of the Russian Federation). This involves deregistering them. The legislation does not establish within what time frame this should take place; therefore, the procedure can take a long time.

Therefore, a practice has developed when a clause (with signatures of both parties) is included in the purchase and sale agreement on the timing of the removal from the apartment of the previous owner and his family members. If there are minor children in the family, then the situation with their discharge is different: permission from the guardianship and trusteeship authorities to sell an apartment if there are children registered in it without providing them with a new place of residence in compliance with all standards (sanitary and other) cannot be obtained. Therefore, the issue of new registration of children must be resolved before the sale of housing.

A period of three days has been established for consideration of an application for deregistration of the former owner of the apartment. After discharge, you must register at your new place of residence within a week. Before the expiration of the 7-day period, no penalties can be imposed.

How long after discharge do you need to register at your new place of residence?

The legislation clearly establishes the time frame within which it is necessary to register - no more than seven days from the date of arrival at the new place of residence. Registration authorities must review the submitted documents and register the applicant within three days.

In the event that the locality does not change, the countdown begins from the moment of deregistration. In other cases, in order to prove to migration authorities that the allotted deadlines for registration have not been exceeded, you need to have travel documents with you, as well as confirmation of residence rights (ownership or lease).

Moving to a new place of residence in another city

When changing place of residence or moving to another city for permanent residence, the algorithm of actions is similar: registration in the new place must occur within the same time frame, the applicant must provide the same documents to the registration authority (including travel tickets, if necessary, confirm the date of arrival).

The optimal solution for registration in another city would be automatic deregistration upon registration at a new place of residence.

To do this, you need to have an agreement with the new owner of the former apartment. While in another city, you should:

  • Appear at the territorial registration authority with a passport and an extract from the Unified State Register of Registered Registration Registers for the right to own an apartment, a purchase and sale agreement or a rental agreement. In the latter case, the presence of all adult participants in the transaction is necessary;
  • submit a completed application with a request to register at the specified address, documents for real estate and a tear-off coupon for deregistration from the previous place of residence, consent of the Property Management Department (if registering in municipal housing not with close relatives);
  • get a temporary certificate instead of a passport (valid for 30 days) and wait for the results;

After a request for an extract has been sent, the procedures for its consideration and decision have been made, the applicant will be sent a written notification that the extract and registration are ready. After this, you need to go and exchange your temporary ID for a passport with registration.

Periods of registration at the place of stay

Russian citizens who live outside their place of permanent residence for more than 90 days must register at their place of residence (without deregistration).

Foreigners who come to the Russian Federation for one reason or another also need to register at their address. In accordance with the Law of the Russian Federation No. 109-FZ and the Decree of the Government of the Russian Federation No. 9 of January 15, 2007, foreigners who have received a residence permit or issued a visa must register their residence within seven days.

How long can you live without registration in your passport without breaking the law?

Residence without a permanent residence stamp in the passport will be considered legal if the seven-day period for submitting the registration application and documents is not exceeded. After submitting an application, it can be reviewed from three to eight days (excluding weekends and holidays).

An error was made when registering in your passport: what to do in this case

The situation when registration workers make mistakes when affixing a registration stamp is quite common. In a number of cases, employees of the registration authority stamp the passport “Canceled” and put a new one with the correct data entered.

Another option: the old stamp is crossed out, “Wrong” is entered, and then a new one is affixed.

The problem is that, in accordance with the Administrative Regulations, no corrections can be made to the passport, the “Cancelled” stamp is not provided for it (FMS order No. 339 of December 7, 2007), and the corrections made and extraneous entries make the passport illegitimate. A different situation arises when a citizen deregisters and does not obtain a new registration. In this case, he violates the law and may be subject to administrative liability in the form of a fine, so the more correct solution would be to legalize his residence as soon as possible.

Methods for obtaining a confirmed account in the system

A verified account provides ample opportunities for receiving municipal and government services, so users are wondering how to it to government services. In practice, there are 4 ways to confirm an account on the portal:

1 way - through the MFC. Personal presence of the client is required. For identification, an identity document and SNILS are used.

Method 2 - through a secret code. It can be sent by registered mail. Delivery time is up to 2 weeks.

Method 3 - using an electronic signature. An individual can obtain it from an accredited certification center. EDS is provided for a fee.

Method 4 - through Rostelecom. The client must provide a passport and another document of his choice (SNILS, TIN, international passport and others).

Method 5 - via Internet banking. The option is available in the Internet banking of Sberbank, Post Bank and Tinkoff Bank. To confirm your personal information, just follow the link in your personal account.

Setting up an account is a recommended procedure aimed at increasing the protection of client confidential information. It also allows you to change personal data due to irrelevance. This information may be required to receive electronic services and fully operate the system.

Validity period of the Russian Federation Citizen Passport:

  • from 14 years - until the age of 20;
  • from 20 years to 45 years of age;
  • from 45 years old - indefinitely.

When a citizen (with the exception of military personnel serving on conscription) reaches 20 and 45 years of age, the passport must be replaced.

For military personnel undergoing conscription military service, passports are issued or replaced upon completion of the established period of conscription military service.

Issuance and replacement of passports:

The issuance and replacement of passports is carried out by the territorial bodies of the Federal Migration Service at the place of residence, or at the place of application of citizens in the manner determined by the Ministry of Internal Affairs of the Russian Federation.

To obtain a passport, a citizen submits:

  • Application for the issuance (replacement) of a passport in form No. 1P, filled out manually or typewritten by the citizen who applied for a passport. The citizen’s personal signature on the application is certified by an authorized employee (civil servant, department employee). If a citizen is unable to fill out an application on his own, it is filled out by an employee of the unit.
  • Birth certificate. If a citizen does not have a birth certificate, he is recommended to contact the civil registry office at the place of birth registration or the civil registry office at his place of residence to obtain a repeat birth certificate. If it is impossible to provide a birth certificate (repeated birth certificate), a passport may be issued on the basis of other documents confirming the information necessary to obtain it.
  • Two personal photographs in black and white or color, size 35 × 45 mm, with a clear image of the face strictly from the front without headdress. It is permitted to submit photographs wearing hats that do not hide the oval of the face by citizens whose religious beliefs do not allow them to appear in front of strangers without hats. For citizens who constantly wear glasses, it is mandatory to take photographs with glasses without tinted lenses. If technically possible, photographing and obtaining photographs can be carried out directly at the unit.
  • Documents evidencing citizenship of the Russian Federation (if it is necessary to confirm the citizenship of the person applying for a passport).
  • Documents required for making mandatory marks in the passport (military ID, birth certificates of children under 14 years of age, documents confirming registration at the place of residence).

Citizens who have permanently resided outside the Russian Federation and arrived at their place of residence on the territory of the Russian Federation, as well as permanently reside outside the Russian Federation, must submit documents identifying themselves as a citizen of the Russian Federation outside the Russian Federation in order to be issued a passport. Citizens who acquired citizenship of the Russian Federation directly on the territory of the Russian Federation present national documents proving their identity.

A citizen has the right not to submit documents certifying Russian citizenship, issued in connection with a change of citizenship on the territory of the Russian Federation, but only to indicate in paragraph 8 of the application for the issuance (replacement) of a passport in Form No. 1P (Appendix No. 1 to the Administrative Regulations) information about the territorial body who has decided to change citizenship.

In the case of the initial receipt of a passport by a person who acquired Russian citizenship outside the territory of the Russian Federation, the citizen provides information about the date of acquisition of Russian citizenship and the body that made the decision to change citizenship.

To replace a passport, a citizen submits:

  • Application for issue (replacement) of a passport in form No. 1P;
  • Two personal photographs of the established type;
  • Documents confirming the grounds for replacing the passport specified in paragraph 12 of the Regulations on the passport of a citizen of the Russian Federation, approved by Decree of the Government of the Russian Federation of July 8, 1997 No. 828
  • Documents required for putting marks in the passport (military ID, birth certificates of children under 14 years of age, supporting documents, marriage registration certificate, divorce certificate).
  • Receipt for payment of state duty.

In cases of theft or loss of the Passport of a citizen of the Russian Federation:

If a passport is lost (stolen), a citizen submits a written statement indicating where, when and under what circumstances the passport was lost (stolen), an application for the issuance (replacement) of a passport in Form No. 1P, four personal photographs of the established sample, as well as a receipt on payment of state duty.

When a passport is stolen, a citizen

submits an application to the internal affairs body of the Russian Federation and submits to the unit a notification coupon for registration of an incident report, provided for in Appendix No. 5 to the Instructions on the procedure for receiving, registering and resolving statements, messages and other information about incidents in the internal affairs bodies of the Russian Federation, approved by Order of the Ministry of Internal Affairs of Russia dated December 1, 2005 N 985.

Attention!

A citizen has the right not to submit a notification coupon. If it is not submitted, the citizen must indicate in a free-form application when and to which unit of the internal affairs bodies of the Russian Federation he contacted the fact of the theft of his passport.

In cases where measures to establish the identity did not give positive results (the file cabinet with applications for the issuance (replacement) of a passport in Form No. 1P, address and reference records, etc., has not been preserved), the citizen additionally submits the documents he has (birth certificate, imprisonment certificate) (divorce) of marriage, military, trade union, hunting tickets, certificate of release from prison, main document identifying the citizen of the Russian Federation outside the Russian Federation, work book, pension, driver and other licenses).

Payment of state duty:

  • For issuing a passport of a citizen of the Russian Federation
    - 200 rubles.
  • For issuing a passport of a citizen of the Russian Federation
    to replace a lost one or one that has become unusable - 500 rubles.
