Why might you need information from the BTI?

  • When the owner changes as a result of a purchase or sale transaction, donation, inheritance, and so on. When registering these actions in a justice institution, a registration certificate and various BTI certificates are mandatory.

Error on the BTI plan - what to do?

Hi all.

I am going to remodel a brick house built in 1960 (the house was built according to an individual project), in particular I want to demolish the partition between the bathroom and toilet. I discovered that on the BTI plan, part of this partition is drawn THICK (see attached picture). The registration certificate for the apartment states that the plan was drawn up based on an inspection in 1990.

In fact, the partition between the bathroom and the toilet looks completely different from the one on the BTI plan! (again see attached picture). This partition rests at one end on a small ventilation duct, has a thickness of approximately 90mm throughout its entire length and is made of brick with an edge.

I have two ideas why this might be:

  1. The previous owners made an uncoordinated redevelopment, cutting down part of the wall or part of the ventilation duct. This option seems unlikely to me, mainly because the entire decoration of the apartment, including door frames, ventilation grilles and other engineering structures, clearly comes from the 60s of the last century and is covered with many layers of paint.
  2. It is possible that on all floors except the lower ones the partition looks exactly as it does on the BTI plan and there are ventilation ducts inside it. My apartment is on the second floor, so I only have one ventilation duct to the neighbor below. My neighbor above should already have two ventilation ducts: to my lower neighbor and to me, and therefore the ventilation riser should take up more space. It is quite possible that in a typical apartment above me, the ventilation riser takes up three to four times more space than mine. Maybe the BTI plan does not show my specific apartment, but a typical apartment located above me?

The actual question is: how to bring the BTI plan into line with the real state of affairs?

The preliminary conversation at the BTI did not yield anything good: they threatened that if they called a technician, he would draw it on the plan as an illegal redevelopment with red lines. They say that the only thing they can do is to look up the archives with construction documentation for the house and see what was there. This seems to me to make no sense, and it is clear that all these years they have been redrawing that same construction plan.

To be honest, I don’t understand what to do now. I didn’t do the redevelopment and I doubt that anyone did. I understandably don’t want to restore the wall “as on the BTI plan.” Are there any other options to legitimize the change in the BTI plan? Help!!!

General rules for submitting a request to the BTI

To obtain the necessary information, first of all, you should collect a certain set of documents. It depends on the purpose and composition of the requested information. After preparation, you need to contact the BTI, which serves a certain area. Since information about a building or premises in it is required, you should only contact the state or municipal BTI, since commercial structures may not have the necessary data.

  • Provide the institution with a package of documents in accordance with the list. In most cases, you do not have to provide the original; a copy, previously certified by a notary, is sufficient.

However, you should take into account the fact that not every apartment redevelopment can be approved. This applies to cases where the load-bearing structures were greatly affected during the redevelopment. The owner of such housing will be fined and required to restore the structure as soon as possible.

If the redevelopment is not agreed upon with the BTI technician, all inconsistencies are marked on the floor plan with so-called “red lines”. In this regard, the buyer of such real estate will immediately see on the apartment plan all illegally made structures and partitions. If the buyer does not refuse such an apartment, then most likely he will not insist on providing him with a significant discount, since the responsibility falls not on the one who did the redevelopment, but on the one who owns the housing.

So, if you have a redevelopment done in your apartment, then it is better to legalize it or get approval for it in advance and then calmly put it up for sale at the market price, and not at a greatly reduced cost.

As you can see, documents issued by the BTI can be received very quickly, if you do not break the law, and if there are no unauthorized redevelopments in your apartment.
