Responsibilities of a cadastral engineer for land surveying

In December 2020, a BTI cadastral engineer prepared a boundary plan (diagram) for the location of the land plot on the cadastral plan of the territory.

    As you know, land is a very valuable resource. In this regard, it is subject to careful consideration. One of its important parts is the state granting a specific site a certain status. In this case, we are talking about the purpose of this site and the permitted activities for which it can be used. If a situation occurs where the use is not in accordance with these characteristics, this can lead to quite serious consequences. In order to have confidence in their actions, the owner of the land or its tenant must know exactly the legal status that the plot of land in question has.
  3. If the property has not previously been registered with the state, this must be done as soon as possible. After all, only correctly done state registration of ownership of real estate guarantees its protection. This may be needed not only for objects that have not previously been registered. It may also be considered to split one plot into several smaller plots or, conversely, combine several into one. In all cases, it is necessary to issue a cadastral passport for real estate. — Good afternoon, Sergey Grigorievich, thank you for agreeing to answer our questions. To begin with, please tell me why you chose the profession of cadastral engineer?

— In those years when I was studying at the institute, such a profession was not known in our country. It appeared only a quarter of a century later as a necessary provision of new conditions for economic activity. By basic education, I am a cartographer, but my current profession requires competencies in the field of land management, geodesy, cadastral work, and legal knowledge. All these hypostases enrich and complement each other.

— What do you especially like about the profession of a cadastral engineer?

— Absolute unpredictability of work results. The same actions of an engineer under similar conditions can lead to both complete triumph and absolute failure due to the nuances and pitfalls that arise at every step. It is all the more interesting to find a way out of seemingly dead-end situations, to unravel tangles of contradictions, and even to respect the interests of the customer and not deviate from the current legislation.

— What, in your opinion, is the most important thing in the work of a cadastral engineer?

— The ability to notice and not lose sight of details that seem insignificant to a non-professional eye, to take in the entire situation. And the overall picture consists of topographic and cadastral situations, the legal framework, the interests of the customer and his neighbors. The task of the cadastral engineer is to bring this motley landscape to harmony, because in the vast majority of cases, complete chaos reigns at the starting point. And sometimes one misread number in an old, half-decayed document, one misinterpreted word in an article of some law, one glitch in the process of satellite observations can cancel the result of painstaking multi-day work.

— Which cadastral engineer service is the most in demand?

— Both now and fifteen years ago, the most popular and most difficult task of a cadastral engineer concerns the correct registration of summer cottages. Laws and governments change, dacha amnesties are announced, multifunctional centers and electronic databases are created, but it is not getting any easier for a dacha resident to register his own plot. Sometimes this simple task turns out to be completely unrealizable. Many residents of the Kamchatka Territory have encountered this and understand what we are talking about.

— What difficulties do you encounter in your work, what problems are relevant today for cadastral engineering in Russia?

— Since the initial formation of the profession of cadastral engineer, our activities have been reminiscent of a game of chess, in which the rules of the game change every three moves, and the player does not even know about it. And checkmate to the king does not at all mean a won game. During this game, both the king's bishop and the third pawn from the left could become the main figure on the chessboard. It is impossible to list only the main problems in one interview, and they are not interesting to the average person. Complaining about circumstances is generally not the most worthy thing to do. A true professional is distinguished by the ability to find a way out of any situation.

— How can you find out how professionally a cadastral engineer performs his work and whether he has the right to make mistakes?

“Sometimes it’s enough to look at the public cadastral map on the Rosreestr website with a background of satellite images included. Sometimes you can see a dacha plot there, lying diagonally on top of other plots, or the outline of a village club building in the middle of a school stadium, or even an entire street of a Koryak village in the depths of the Bering Sea. Any cadastral engineer sometimes encounters mistakes made by colleagues when performing work on neighboring areas. Of course, anyone can make a mistake, but this is fraught with serious consequences that fall on the shoulders of the customer who is unaware of the problems that have arisen. And it is not always possible to correct such mistakes. So, colleagues, double-check the result not seven, but ten times before giving it to the client!

— How effective do you think the latest innovations in the field of cadastre and real estate are in practice?

— If we talk about the regulatory framework, then often the adoption of changes in long-standing laws simply drives us into a stupor and forces us to completely redesign all technologies for working with land management documentation. But from a technical point of view, the progress of technology at the beginning of the millennium simply rushed upward with acceleration. With the development of digital and satellite geodetic systems, the topographic and surveying component of our profession has changed beyond recognition in the direction of increasing accuracy, quality and efficiency of work. Nowadays, unmanned photography is also coming into use. With the proper use of new technologies, the result is very impressive.

— What are the prospects for the profession of cadastral engineer, will it remain in demand?

“This profession is only fifteen years old, and during this time the cadastral engineer has gradually transformed from a surveyor with a pedometer in his hands to a universal specialist in working with any real estate, and not just land plots, as was the case until recently. Now the cadastral engineer is a full participant in all relations between objects on the ground on the one hand, citizens and organizations on the other hand, and government agencies on the third. As long as these relationships exist, the profession will be in demand, no matter what it is called in the future.

Internship as an assistant cadastral engineer

Cadastral activities and cadastral engineers

The terms “cadastral engineer” and “cadastral activity” appeared relatively recently in the Russian Federation and are primarily associated with the concept of “real estate”. After all, it is for the registration of legal rights and taxation of property that a whole system of data on all real estate objects is created.

In modern conditions in the Russian Federation, relations related to the maintenance of the state real estate cadastre, the implementation of state cadastral registration of real estate and cadastral activities, regulated by the Federal Law “On the State Real Estate Cadastre” and a number of other legal acts, have become particularly relevant.

These regulations, in particular the Cadastre Law, provide the cadastral engineer with a fairly large amount of rights and powers. At the same time, due to the significance of his activity, the cadastral engineer bears many responsibilities that provide for high responsibility for the cadastral work performed.

Cadastral activities may only be carried out by a person who has passed the appropriate qualification exam and has a valid qualification certificate of a cadastral engineer.

Information about cadastral engineers is entered into the state register of cadastral engineers. This information resource is maintained by the Federal Service for State Registration, Cadastre and Cartography (Rosreestr). The register is posted on the official website of Rosreestr on the Internet (rosreestr.ru), information about the cadastral engineer is publicly available and is provided at the request of any interested parties.

A cadastral engineer has the right to carry out his activities as an individual entrepreneur or as an employee of a legal entity on the basis of an employment contract with such a legal entity.

It is legally stipulated that a legal entity performing cadastral work must have at least two active cadastral engineers on its staff, and also be responsible for the safety of documents received for carrying out cadastral activities. In addition, legal entities and individual entrepreneurs carrying out cadastral activities do not have the right to disclose information obtained as a result of professional activities.

Currently, more than 500 cadastral engineers operate in the Omsk region.

Cadastral work is carried out by a cadastral engineer on the basis of a contract for cadastral work concluded in accordance with the requirements of the law.

In cases provided for by the legislation of the Russian Federation, cadastral work can be performed by a cadastral engineer based on a court ruling.

Under a contract for the performance of cadastral works, a cadastral engineer who is an individual entrepreneur, or a legal entity whose employee is a cadastral engineer, is obliged to ensure the implementation of cadastral works on the instructions of the customer of these works and to transfer to him the documents prepared as a result of the performance of these works, taking into account the requirements of the Law on cadastre, and the customer of these works undertakes to accept the specified documents and pay for the cadastral work performed. As a result of the above-mentioned cadastral work, documents are prepared for submission to the cadastral registration authority of an application for registration of a real estate object or real estate objects, for recording changes in a real estate object, for registering a part of a real estate object, or for deregistration of a real estate object. The volume of cadastral work to be performed is determined by the customer of cadastral work.

It should be noted that a contract for cadastral work may provide for the customer’s obligation to pay the price stipulated by the contract for cadastral work in full after the state cadastral registration of real estate objects in respect of which cadastral work was carried out in accordance with such a contract.

The result of cadastral work is a boundary plan (when performing work in relation to land plots), a technical plan (when performing work in relation to a building, structure, premises or an unfinished construction site), or an inspection report (when performing work in connection with the termination of the existence of a building, structure , premises or object of unfinished construction).

Considering that currently only cadastral engineers are authorized to carry out cadastral activities in relation to all real estate objects subject to state cadastral registration, their importance and role in the life of society will invariably increase, since the activities of a cadastral engineer are closely related to the real estate market, which has historically been one of the main segments of the economy and society.

Taking into account the above, I would like to note that the cadastral engineer, while carrying out his activities, bears independent responsibility, including administrative and criminal. A cadastral engineer must be highly qualified and fully know, apply and, most importantly, comply with current legislation.

In case of particularly large damage (from 6 million rubles), the fine will be 500 thousand rubles, the license will be suspended for 3 years, and correctional labor will be imposed for 1 year.

Education of a cadastral engineer

For legal cadastral activities, an individual must have a secondary specialized or higher specialized education and pass the qualification exam of a cadastral engineer.

After completing the certification, those who successfully pass the exam are issued a permanent certificate confirming their qualifications. After which, the executive authority sends a copy of the issued document to the accounting authority within one working day, and the cadastral engineer begins to perform his duties after information about him appears in the state register.

It is important to know:

Applicants with an outstanding criminal record and citizens of other states are not allowed to take the exam.

The specialist bears responsibility (including criminal liability) for his activities.
