What is a cadastral passport?

This is a document that acts as confirmation of the fact of state registration of a residential premises. During this procedure, the property is assigned a personal number, under which it is entered into the register. As for ownership, the document did not confirm it, so the owner should have had a certificate in his hands.

In some cases this is true, in others it is not. For example, any redevelopment of a premises or building must be agreed upon with the BTI authorities and the Cadastral Chamber so that the changes made are legal and do not entail a fine. The same can be said about the validity period of a cadastral passport for a land plot: in fact, it is unlimited. Mandatory unscheduled inventory must be carried out if:

  • the owner’s personal data has changed, for example last name;
  • the owner has changed his place of residence;
  • the official address of the site has been changed;
  • the category of land or its external boundaries have changed.

According to current legislation, the validity period of a cadastral passport for non-residential premises or for any residential property is unlimited, but this provision is not officially enshrined anywhere. Lawyers recommend that owners of plots, buildings and premises make any changes not only to the technical, but also to the cadastral passport. Formally, the owner cannot be forced to change the cadastral passport just because five years have passed since the last inventory, especially if the registration object has not undergone any changes.

During a scheduled or unscheduled inventory, however, you can change the cadastral passport of an object, and it is best to do this. When registering property rights, the registration authority may request a cadastral passport that was produced no earlier than five years before the date of application, even if no changes have occurred during these five years. Employees of registration organizations have the opportunity to freely interpret the 2000 resolution due to the inaccuracy of the wording. In fact, the registering authority has the right to request not a new cadastral passport, but only confirmation that the status of the object corresponds to the data in the passport produced more than five years ago. However, obtaining such confirmation will still take a lot of time from the applicant, so it is better to prepare a new passport in advance.

Thus, the validity period of a cadastral passport for any object is virtually unlimited, but requirements for scheduled and unscheduled inventory can be used to request from the owner a document reflecting the current status of the object. It is best to proceed from the provision of a planned inventory at least once every five years and prepare a new cadastral passport in advance, preventing the document from becoming outdated.

Why was a cadastral passport needed?

  • Conducting transactions with real estate with subsequent registration of transfer of ownership.

What is cadastral documentation?

Residential and non-residential premises are real estate objects. In order to distinguish objects from one another, their cadastral registration is carried out, during which each object is assigned its own number in the cadastre.

Information contained in the State Real Estate Cadastre (GKN) is publicly available. For objects that are registered, information from the State Property Committee is provided in the form of a cadastral document (passport). Any citizen of the Russian Federation has the opportunity to obtain a cadastral passport.

We issue a cadastral passport

A cadastral passport is an extract made from the state real estate cadastre. It contains all the information regarding the property that is necessary in order to carry out its state registration:

  • cadastral number assigned to the object and the date of its entry into the cadastre;
  • type of object (residential property or apartment, unfinished construction, industrial premises, etc.);
  • description of the location and boundaries of the object on the plot of land, as well as its address;
  • how much is real estate worth according to the cadastre;
  • object area;
  • number of storeys;
  • the presence of a balcony, utility rooms, etc.;
  • materials from which the property was built;
  • availability of communications.

In addition to the text description, the document also contains a graphic part, which is a dimensional drawing of the property plan.

Important. Despite the fact that any citizen has the opportunity to obtain a passport, both for his own property and for someone else’s, however, making changes to the cadastral documentation is possible only at the request of the owner. After which a new cadastral document with updated data is issued.

Nuances of obtaining a document

To do this, you only had to present an application, as well as an identity document (passport). Information from the Unified State Register of Real Estate is publicly available.

There are two options for obtaining this document:

  1. Using the Rosreestr website. This option is suitable in a situation where you need to receive a document in electronic format, when you need to check the purity of the transaction from a legal point of view. The procedure will take no more than a few minutes. The document is certified with a digital signature, and the information specified in it is completely current at the time of receipt.
  2. Through multifunctional centers. The application can also be submitted through them; in this case, the applicant can count on receiving a paper version of the document, which may be needed in the process of conducting real estate transactions. The application is submitted to a specialist, then a date is set on which the applicant can come to receive the finished document in paper form, which is certified by a seal.

Regardless of the chosen method, the procedure associated with obtaining this document is as simple and quick as possible, so you can handle it on your own.

What list of documents will be required?

One application and a passport are enough. You will need to provide a receipt for payment of the state duty. Some time ago, it was also necessary to present title documentation for the apartment.

When can I receive it?

They depend on the authority through which the procedure is carried out.

  • If you act through Rosreestr, or more precisely, through the website of this organization, you will have to wait 4-5 days until the document is produced.
  • If you contact the MFC, the deadline will extend up to 7 days due to the nuances that arise in the process of interaction between departments.
  • The easiest and most convenient way is to contact a private company that will represent the interests of the applicant. It will cost more, but the time frame will be significantly reduced - to several days.
  • You can also receive the paper by mail, but it is worth noting that the deadlines have been increased, although it takes service employees about 4 days to prepare the document. This procedure is carried out if the property is located in another city. If some time ago it was necessary to contact the place of registration, today the situation has changed.

Registration procedure

Before you begin the registration procedure, you must first collect a package of documents.
If you are planning redevelopment or registration of an apartment in a new building, you need to call a technical specialist home for registration. He will carry out the necessary work and issue an official document. To enter information about an apartment into the register, the following documents will be required:

  • Statement.
  • Owner's civil passport.
  • Legal documents.
  • Technical passport or court decision, if the redevelopment was legalized.
  • Notarized power of attorney, if a representative acts on behalf of the owner.
  • Receipt for payment of state duty.

Note! There is no need to write an application in advance. Rosreestr or MFC will give you a standard form that you can fill out immediately before submitting your documents.

If the documents are in order, an employee of Rosreestr or the MFC will accept them and issue a receipt. He will set a day when the work will be completed and the documents can be collected. It takes 5 days to complete registration actions from the date of receipt of documents. If you submit documents through the MFC, the period will increase by the time the documents are sent. On average, this takes up to 2-3 days.

An extract from the Unified State Register can also be issued through the electronic service on the Rosreestr website. You will be notified of readiness via email. You can receive the finished document in paper or electronic form.

Validity period of the cadastral passport

It is valid as long as there are no changes in the Unified State Register. If they are implemented, the data in the document changes, and in fact a new document is received. In general, according to the law, the paper is unlimited, but there are nuances, or rather cases in which a new document is required:

  • Planning to purchase a new apartment, which requires checking the purity of the transaction (to make sure that the information provided by the seller is 100% reliable and up-to-date, you should order an extract yourself, without trusting the seller).
  • The desire to apply for a mortgage so that the statement is not overdue (often banks set specific validity periods for documents; in order not to be refused due to an allegedly overdue statement, a new document should be ordered).
  • The need to approve the redevelopment or reconstruction of the home (since this work is complex and requires taking into account all the details, the data in the document must be as truthful as possible; in order to protect yourself, you should order a new passport).
  • Transfer of ownership (when buying an apartment or registering it as an inheritance, you must make a new passport, since the previous document becomes invalid).
  • Making changes to the register (they may affect not only persons who own real estate, but also some situations, for example, redevelopment).

How to obtain and correctly issue a cadastral passport for a garage

Since the beginning of January 2020, changes have been made to the cadastral registration of the Russian Federation. Now, instead of a passport and an extract from the Unified State Register, an entire cadastral extract from the Unified State Register is issued. A message about this was recorded in the letter of the Ministry of Economic Development No. 39682-Va dated December 25, 2016. It is a document for registering various transactions, not only when purchasing an apartment, but also when purchasing a garage.

It is required:

  • If the owner of the garage decided to privatize it;
  • when registering real estate alienation transactions.

Is it possible to order a cadastral passport through State Services? This can be done without any problems. This may be a transaction that involves the sale of a gift or the registration of a will, if the owner of the garage has decided to rent it out for a temporary period of more than 1 year, as well as to provide the garage with collateral and when receiving a loan.

Also, if the state plans to move or demolish the GSK, to receive compensation, or another garage box, you also need a passport.

What is better to choose: a paper or electronic cadastral passport on electronic media? It doesn't matter, the important thing is that it has the same legal force. That is, for completing a real estate transaction, such passports are equivalent. Only when ordering by email. option, it will be ready in Rosreestr 2-3 days earlier and will cost you much less.

Options for obtaining cadastral documentation

You can also order a cadastral passport for a property online using the official website of Rosreestr. This does not even require additional registration on the site.

In order to order the production of cadastral documentation, you must click on the “electronic services” tab and select the option “submit a request for information from the State Property Committee”. Then fill out the proposed form on the website and pay the state fee.

Important. If you order cadastral documentation online, payment of the state fee can only be made using a bank card or QIWI.

If cadastral documentation was ordered through the MFC or the Cadastral Chamber, you must pick up the finished documents in person or through your representative.

If you apply for a passport online, you can choose how to receive it:

  • in person, by contacting the Cadastral Chamber or the MFC that the applicant chooses;
  • in electronic form, which, upon the applicant’s request, will be sent to the specified email address. When choosing this method of receipt, you should know that the electronic document will not contain the seal of the competent authority, and, accordingly, will not suit many official authorities;
  • on paper, sent by mail.

What is the validity period of a technical or cadastral passport of the BTI (PIB)

A technical passport cannot have a limited validity period . The legislation does not establish such validity periods for technical passports. Establishing deadlines for the validity of technical passports and other documents issued by technical inventory organizations (certificates, extracts from the register, extracts from technical passports, floor plans, explications, etc.) is illegal and violates the rights of applicants applying to technical inventory organizations for relevant documents.”
