Many people want to get their own plot of land to build a private house. Especially if it is provided without charging any fees.
On the territory of the Republic, certain categories of beneficiaries have this opportunity. They can purchase land for individual housing construction in a certain order. We will tell you further about how to get on the waiting list for a plot of land in Ulan Ude.
How is the queue for a land plot in Ulan-Ude formed?
Queue to receive a land plot
The allocation of free land is carried out according to the rules established by the Law of the Republic of Belarus No. 115-III “On the free provision of ownership of land plots that are in state and municipal ownership.”
According to its provisions, certain categories of persons are once allocated free of charge plots of land for the construction of private houses. They are provided in accordance with the queue formed by the authorized body.
Therefore, to receive such land you need to be registered. This queue is formed on the basis of applications submitted by beneficiaries.
After receiving the documents, the persons carrying out the registration must review it within thirty days and make a decision on whether to satisfy it or refuse it. The applicant must be notified of the results of the review.
Applicants are included in the queue based on the date of receipt of all required documents from them. However, a number of citizens can receive plots on an exceptional basis. Separate lists are maintained to keep track of them.
According to the above law, citizens with many children (if they have three or more children) have this priority right.
They can refuse to be included in the queue only if they do not have rights to free land. After registration, exclusion from the queue is possible. The grounds for this are provided in paragraph 8 of Art. 1.1 of the Law.

This is important to know: What is interesting and useful to know about documents for the sale of land
Changes in the procedure for providing land allotments to people with many children suggest, from March 2020, the opportunity to receive free housing instead of land. Naturally, the family itself must agree to this. In this case, various options for accomplishing this task are possible. Among them:
- a free house or apartment is allocated from the social fund;
- housing is provided on social rental terms;
- subsidies are allocated for the purchase of housing, partially covering its cost.
In the latter option, this may be repayment of interest or the principal of the mortgage loan. Starting from 2020, large families will have to decide not only whether to choose a plot of land or an apartment, but also in what form to receive this assistance from the state. This rule is not mandatory. Local municipal law may not provide for the possibility of replacing a piece of land with free housing. You can learn about all the intricacies of such procedures by using the services of a lawyer specializing in this area, or by contacting specialized bodies.
In addition, with the introduction of a new norm for queuing, other restrictions were introduced. Now, if the grounds for improving housing conditions arose as a result of the sale or donation of pre-existing housing, such a cell will be able to apply for an allotment only 5 years after the conclusion of the donation or sale agreement.
As of 2020, large families include not only those families where the parents are legally married, but also if three or more children are raised by one of the parents. And the plot is allocated for the joint use of each family member.
Categories of persons included in the queue
Not all residents of Buryatia can take advantage of the provided opportunity to receive land plots free of charge. The said Law lists all persons who can apply for the allocation of such plots. These include:
- citizens officially recognized as needing housing (under a social tenancy agreement);
- families with three or more natural or adopted children;
- citizens of the Russian Federation participating in the program of resettlement of compatriots living abroad to the Russian Federation;
- persons who are owners of land plots affected by mudflows in 2014 in the village of Arshan, Tunkinsky district of the Republic of Belarus, when it is impossible to use such land plots for the purposes of individual housing construction without their reclamation;
- persons who have actual use of land plots for individual housing construction, but have not registered their rights in the prescribed manner;
- citizens who have in their use plots with residential buildings built before December 31, 2010, the rights to which have not been registered;
- citizens of the Russian Federation legally residing in the Republic of Buryatia, whose (average per capita) family income is below four times the established minimum subsistence level on the day of application.
In addition, it is required that these persons reside permanently in the city. The allocation of land is allowed if they previously did not own (property) land plots used for the construction of private or country houses. This rule does not apply to citizens with many children.
The procedure for implementing the rights of large families locally
Federal Law No. 138 of June 14, 2011 provides for the transfer to local governments of determining the procedure for implementing the provisions of this law. In municipalities of the Russian Federation, local legislators develop relevant laws. They are the ones who establish the norms and requirements for the allocation of land plots to parents with three or more children. Often these standards differ significantly in different regions and regions of the country.
According to local laws and regulations of local authorities, issues such as:
- allocation of zones within the jurisdictional territories of cities and regions for the implementation of Federal Law No. 138;
- determining the size of allocated areas;
- the possibility of allocating housing in exchange for land;
- determination of criteria for the need to improve living conditions;
- putting families on the waiting list.
This is important to know: How can you check the cadastre number of a land plot?
According to federal law, a plot of land must be allocated according to the place of registration and residence of citizens. But this requirement cannot be met for residents of the Moscow region and St. Petersburg.
Within the boundaries of these cities there are simply no free plots for individual construction. Therefore, land for large families in Moscow and St. Petersburg in 2020 will be allocated not in the city itself, but in the corresponding areas. But in order to receive land in the Moscow region in 2020, a large family living in Moscow must apply to be placed on the waiting list at the place of registration. For large families living in Moscow, in 2017 land will be allocated in the amount of up to 0.15 hectares.

And if a resident of the region simply wants to receive a plot of land for construction directly from the state, rather than buying it on the secondary market, is there any opportunity to buy it here for a reasonable price?
Answer
Queue order
To queue, you must follow a certain algorithm:
- Get a certificate for a large family.
- Obtain the status of a family in need of housing.
- Prepare other necessary documents and their photocopies.
- Fill out the application and provide documents to the employees of the municipality of the Republic of Bashkortostan.
- Receive an answer about placing the family in the electronic queue or an official refusal.
Local government agencies have the right to refuse a married couple even if they meet the basic requirements for the following reasons:
- one of the children received full legal capacity;
- the child is fully dependent in state institutions;
- one of the family members changed his registration and moved to another region;
- providing false information;
- parents are deprived of their rights to their children or one of them.
How to obtain the status of a family in need of housing?
Having this status is a prerequisite for obtaining land. To do this, you need to submit a corresponding application to the social authorities. Along with this application, you can simultaneously submit an application for recognition of a married couple as a large family.
The following documents are attached to the application for recognition of a family in need of housing:
- Passports and certificates of all members of a large family.
- Property documents or other documents confirming the legal basis of the family’s residence in the area where they live.
- Certificate of family composition from the passport office.
- Marriage documents.
- Documents confirming that the residential premises do not meet the minimum regulatory requirements for living space per person.
- The commission’s conclusion recognizing the living space as not meeting technical or sanitary standards.
- Other compelling reasons, documented, about the right of a family to be considered in need of housing.
Based on the grounds presented, social authorities make a decision to recognize the family as in need of housing and issue an appropriate conclusion.
Documents for placing in the electronic queue
To obtain a plot of land, you must submit an application and submit documents to the local municipality. This can be done with the help of a multifunctional center, as well as a direct visit to the administration of the city of Ufa or the Republic of Bashkortostan.
It is important to prepare photocopies and originals of the following documents:
- Passports and certificates of parents and children.
- Documents confirming official marriage.
- Certificate of a large family.
- Conclusion recognizing them as needing housing.
- Certificate of family size.
- Documents confirming the registration of all family members in this region for more than 5 years and their Russian citizenship.
- Documents on the adoption of children.
The administration may also require other documents if the family is applying for additional privileges, for example, those related to disability and placing the family out of turn.
Statement
The application form can be obtained at any multifunctional center or locality administration. The procedure for filling it out:
- name of the administrative body;
- passport and contact details of the applicant;
- Title of the document;
- personal and passport data of all family members indicating their age;
- it is necessary to indicate the purpose of using the land and the desired location of the site;
- a list of all documents provided along with the application;
- parents' signatures;
- date of application.
Within a month, the administration is obliged to notify the family in writing of the decision. If the answer is yes, the family is placed in an electronic queue, which can be tracked on the public services portal of the Republic of Bashkortostan.
Procedure for obtaining land
When it comes time to receive a plot of land, the married couple is notified of the location of the land allocated to them. They must decide whether this site satisfies them or whether they will wait for the next option.
In the Republic of Bashkortostan there are no restrictions on the number of possible refusals by a family. But if letters notifying about the assigned site are not received three times, the married couple is removed from the electronic queue.
If the couple agrees to receive the proposed plot, it is surveyed, documents are drawn up in Rosreestr and documents are issued to the new owners.
Unfortunately, not all regions act legally and allocate land plots in accordance with established requirements. Some entities that are unable or unwilling to allocate quality land force people to renounce their right to receive a plot.
What is a queue?
In the latter case, the citizen must submit the request in writing. An official document is issued based on it - a certificate indicating data on the progress of the queue at the time of submitting the request. The processing time depends on the workload of the administration staff and the availability of a queue in the relevant department.
Methods for submitting documents
In accordance with Federal Law No. 161 of July 24, 2008, land plots (LZ) that are in federal ownership can be transferred to the disposal of municipal authorities for provision to large families. They are transferred for personal use with further registration of ownership free of charge. The main condition is that a large family must have three or more children under 18 years of age at the time of application, as well as students under 23 years of age (full-time study), and it must be classified as needy.
