  • It is impossible to divide a land plot if the capital construction object located on it cannot be divided simultaneously with the allocation of the land share. That is, land plots with apartment buildings, administrative and industrial buildings are “doomed” to be indivisible. And the owners of the premises in the building will have to be in common ownership of the land.

Important point. If the building can still be divided into premises and a corresponding share can be allocated to each owner (taking into account the land under the house), then division of the plot is possible. It is possible to simultaneously divide the house and land. It is legally possible to divide a residential building into parts (by preparing a technical plan for the premises) without dividing the plot. But a plot of land without dividing a house (if the house is also in shared ownership) is impossible. If the building has not been registered or for some other reason is not included in shared ownership, the plot can be divided, observing the remaining rules of division.

  • You cannot divide a plot if it is prohibited by law. For example, a plot for a peasant farm cannot be divided if one of the members wants to allocate his own plot. Only specialists can explain such nuances to you.

At the same time, the preferential right to receive and use land will not belong to anyone.

The first and most optimal type of division is a contract or agreement. The owners prepare all the necessary documents, give their consent to the division and jointly sign the agreement.

Then all the required documents and the agreement are submitted to the local administration department in order to approve the boundaries of the new plots and check the possibility of division.

After all documents have been verified by the municipal organization, the owner must apply to the Registration Chamber in order to register ownership by submitting a written application and the necessary papers within the prescribed period.

Other types of land division include judicial division. It is required in cases where share owners cannot come to a common decision or believe that their legal rights are being infringed by the actions of other share owners. Soil requirements

If there is more than one owner. In the case where the plot is owned by several persons, this means that it is a common value. There may be several options in such a situation. If both owners agree among themselves on the division of the plot, then they will have to carry out the same procedures for dividing the land as in the case of one owner (land surveying, land management, cadastre, registration). Two owners will be indicated in the documents. As a result, you will receive two plots, but both of them will still be in common ownership. Of course, another option is much more often used, when the plot is divided into two, and as a result, each owner receives a plot. Thus, the common ownership ceases, and both owners become the sole owners of their plot. In this case, it is necessary to draw up an appropriate agreement before the start of land surveying.

Exception As a result of the division of land, several plots are formed, but the original plot ceases to exist. But there is an exception. It concerns those land plots that are provided to horticultural non-profit partnerships (SNT), dacha non-profit partnerships or gardening associations of citizens. The division of these lands will take place in accordance with the project for organizing and developing the territory of this non-profit association or another document establishing the distribution of land plots in this non-profit association. When a large plot owned by a partnership is divided, the result is the formation of several plots of land that are intended for gardening, gardening, summer cottage construction, or are classified as common property. The land plot that has been divided remains within the changed boundaries.

Documents for registration are submitted in two ways: in person or by mail with a list of the contents and with a receipt. You will know that the documents have been received thanks to a receipt, which you will also receive by mail. If the application and documents for cadastral registration are submitted by the applicant in person, you will receive a receipt with a list of documents and the date of receipt. The period for cadastral registration is 20 days from the moment the necessary documents are received. State registration This is the final stage, at which it is necessary to provide the following documents: - application; — receipt of payment of the state fee for registration of property rights (500 rubles for each plot); — cadastral passports for land; — a notarized power of attorney, if the documents are submitted by a representative; - documents of title to the land from which the division occurred. Documents must be submitted to the registration service depending on the location of the land plots. This whole process lasts about a month. If there are no grounds for suspension or refusal of registration, then you can receive both certificates of land ownership in no more than a month. And then you can safely sell any of the two plots.

Nuances You can find out whether the division of the plot is possible in the local administration, in the architectural department. You should ask them for the minimum area of ​​the site, since according to city planning regulations there are limits. It is impossible to divide any plot according to your wishes. Suppose you are unlikely to be allowed to divide a plot of six acres into 5.5 acres and 0.5 acres. There should be no intersection of the boundaries of municipalities and settlements with the boundaries of land plots. The formation of land plots is impossible if this formation leads to the impossibility of the permitted use of real estate located on the plots. There will be no division if the encumbrances remaining in relation to the land plots being formed do not allow the use of these land plots in accordance with the permitted use.
