Article 11.10. Layout of a land plot or land plots on the cadastral plan of the territory

The preparation of the scheme must be carried out in the form of an electronic document.

However, in some cases provided for by the Code and other regulations adopted on its basis, it is also possible to provide the scheme in paper form.

In particular, when it comes to preparing a scheme, which is carried out by the citizen himself personally, to provide him with a plot of land without holding a tender or auction, the preparation can be carried out in two forms:

  • in the form of an electronic document;
  • on paper.

When preparation in the form of an electronic document is necessary, you can use a special service on the website of your regional cadastral chamber office. In addition, it is possible to draw up a diagram using special programs and software that are installed on a personal computer.

It is worthwhile to dwell separately on drawing up a diagram using the cadastral chamber website. Preparation of a document in this form can be carried out by any person for a fee. The exact amount of payment and the procedure for collecting it are established at the level of the Government of the countries.

Approval and issuance of land plot layout plans

In the case of the division of a land plot that is in municipal ownership (state ownership of which is not delimited) and is provided with the right of permanent (perpetual) use, lease or free use:

  • statement
  • layout of the land plot or land plots on the cadastral plan of the territory that are proposed to be formed and (or) changed
  • copies of title and (or) title documents for the original land plot, if the rights to it are not registered in the Unified State Register of Rights to Real Estate and Transactions with It
  • a copy of the identity document of the applicant (applicant's representative)
  • a document confirming the right to represent the interests of the applicant (if the applicant’s representative applies)

In case of formation of a land plot for its sale or lease through an auction:

  • statement
  • layout diagram of a land plot or land plots on the cadastral plan of the territory (except for cases of formation of a land plot from lands or land plots located within the boundaries of populated areas)
  • a copy of the identity document of the applicant (applicant's representative)
  • a document confirming the right to represent the interests of the applicant (if the applicant’s representative applies)

Documents provided through interdepartmental information exchange (the applicant has the right to submit them on his own initiative):

  • extract from the Unified State Register of Legal Entities (if the applicant is a legal entity)
  • extract from the Unified State Register of Individual Entrepreneurs (if the applicant is an individual entrepreneur)
  • an extract from the Unified State Register of Rights to Real Estate and Transactions with It (hereinafter referred to as the Unified State Register of Real Estate) on rights to a land plot or a notice of the absence of information in the Unified State Register of rights to a land plot
  • an extract from the Unified State Register of Rights to a building, structure, structure located on a land plot or a notice of the absence in the Unified State Register of Information about registered rights to these buildings, structures, structures
  • cadastral passport of a land plot or cadastral extract of a land plot (in the case of division of a land plot that is in municipal ownership (state ownership of which is not delimited) and is provided with the right of permanent (perpetual) use, lease or free use)

Coordination and approval of the layout of the land plot

The finished scheme is subject to mandatory approval by authorized bodies. In particular, the finished document, executed in electronic or paper form, must be agreed upon:

  • executive authority of a separate subject of the state;
  • local government body.

This rule, by agreement, applies in all cases, with the exception of some established at the legislative level.

Based on the results of reviewing the scheme, the authorized body makes a decision that can either approve it or imply a refusal to approve it.

Form, structure and composition of the land plot layout

The basis of the SPOZU is made up of materials from topographic surveys carried out earlier. The diagram indicates the number of the GPZU, the plan of the residential building, the height (for individual housing construction, a maximum of 3 floors), the type of fencing, communication networks, zone boundaries, access roads and other information. The drawing is done manually (in blue or purple ink, drawing ink) or electronically. A3 or A4 format, white sheet. The text part must be printed and readable.

Composition of the OSD

At the end of the document, a list contains information from cadastral records, namely:

  • cadastral number of the plot,
  • site boundaries,
  • building plan number,
  • total area,
  • location of capital construction projects,
  • marks on the location of future buildings,
  • communication network diagram,
  • driveways,
  • sidewalks.

Requirements and documents necessary for drawing up a site layout plan

The basic requirements for preparing a land plot layout diagram are presented as strict compliance with the established list of documents. If at least one regulatory legal act is missed during production, the finished work may be declared invalid due to its non-compliance.

In order for the scheme to meet all established legal requirements, during its preparation, as well as subsequently, during its approval, the use of the following package of documents is required:

  • documents on territorial planning in a given area;
  • rules for land use and development;
  • project of the future layout of a specific territory;
  • land management documentation;
  • resolutions designating a specially protected area;
  • regulations identifying zones with special conditions for the use of the territory;
  • documents on plots intended for public use;
  • resolution on the location of plot boundaries;
  • regulations containing data on the location of buildings and structures within the boundaries of a certain territory.

The Land Code provides for the possibility of transferring state land into ownership, lease, and free use to individuals and legal entities. To consider the possibility of forming the site you are interested in, it is necessary to provide the executive body of state power or local government with a diagram of the location of the site on the cadastral plan of the territory.

The layout of the land plot on the cadastral plan of the territory is a diagram that displays the projected boundaries and area of ​​the requested land plot on the cadastral plan of the territory.

The layout of the land plot is prepared taking into account approved territorial planning documents, land use and development rules, draft territory planning, land management documentation, regulations on specially protected natural areas, the presence of zones with special conditions for the use of territories, public land plots, public areas, red lines , location of land boundaries, location of buildings, structures, unfinished construction projects.

The layout of the land plot shows:

  • conditional number of the land plot being formed;
  • land area;
  • list of coordinates of characteristic boundary points;
  • image of the boundaries of the land plot being formed, image of the boundaries of the registered land plots, including the original land plots, inscriptions, symbols;
  • information on approval of the layout of the land plot.

The layout of a land plot is approved by a decision of the authority authorized to provide state or municipally owned land plots. The validity period of the decision to approve the layout of the land plot is two years.

Grounds for refusal to approve the scheme:

  • non-compliance of the layout of the land plot with the requirements for its preparation;
  • coincidence of the location of the land plot being formed with the location of the land plot formed in accordance with a previously made decision on approval of the layout of the land plot, the validity of which has not expired;
  • development of a layout plan for a land plot in violation of the requirements of the Land Code;
  • discrepancy between the layout of the land plot and the approved draft territory planning, land management documentation, and regulations on a specially protected natural area;
  • location of the land plot within the boundaries of the territory for which the territory surveying project has been approved.

Application and documents for approval of the site plan

The department of architecture and urban planning will need to provide the following package of documents:

  • a statement containing a request for approval of the drawn up scheme;
  • identification document of the applicant;
  • if necessary, a certificate of registration of the applicant as an individual entrepreneur;
  • certificate that the applicant has carried out cadastral registration;
  • if necessary, a power of attorney;
  • preliminary conclusion issued by the deputy head of the local administration;
  • cadastral plan of the given territory;
  • an act confirming that the postal address has been established;
  • minutes of the meeting on the provision of plots;
  • exact layout of the land plot;
  • documents confirming ownership.

The decision made by the authorized body of the subject or city of the state in relation to each specific plot of land must contain information:

  • about the exact area of ​​each specific plot of land;
  • about the exact address of each site. If it is impossible to indicate the address, it is necessary to create a description of the location of the site;
  • about the cadastral number of the plot. In the case when one single plot of land is formed from several plots, the cadastral number of each initial plot is required;
  • about the territorial zone within the boundaries of which the site is being formed. In a situation where the new site is not subject to special urban planning regulations or is not established for it, it is required to indicate the exact type of use of the land;
  • about the category of land to which the new plot will belong.

The full validity period of this decision is two calendar years.

Scheme approval

The finished layout of the territory on the cadastral plan of the land plot must be approved by the executive body that represents the state government or local government. The decision, which will be made within five working days, must be sent to the federal body representing the executive branch and is authorized in these matters in the given region. The directed solution displays:

  • The total area of ​​the immovable object, which corresponds to the schematic image;
  • The exact address of the location of the territory with its description;
  • Individual cadastral number of the land plot assigned earlier. Required when creating new territories from one site. Changes must be made to the cadastral database;
  • The boundaries of the territory or the intended purpose of the site, if regulations are not established;
  • The category of land to which the real estate belongs.

The decision of the authorized bodies has a limited validity period, which does not exceed two years from the date of receipt, therefore it is necessary to calculate the time of all work carried out.

Refusal to approve the layout of the land plot

The following situations may be used as grounds for refusal of approval by authorized bodies of a scheme submitted to them:

  • the authority identified a discrepancy between the layout of a plot of land and its form, format or preparation requirements established at the legislative level.
  • if during the inspection it was revealed that the site located on the diagram has a complete or partial coincidence in its location with another site approved on the scheme, the validity of which has not expired.
  • if it was revealed that the layout of the land plot on the cadastral plan was developed with violations of the information established for this event.
  • when a discrepancy is identified between the location of the site on the diagram and on the accepted plan of the given territory.
  • when the site is located on the territory for which the boundary plan has been approved.

Layout of the land plot on the cadastral plan of the territory

The layout of a land plot on a cadastral territory is displayed in the form of cordons of one or more plots. Its size is indicated by location; if the area consists of several plots, then the numbers of each. It conveys the number of the place, the size of the land in m2, the display of characteristic units, the position in the coordinate axis - X and Y.

The rules for constructing a plan on a land plot are prescribed in the Land Code of the Russian Federation. In preparation, they use approved documents for a given territory, rules for the use of land and buildings, a drawing of a land scheme, land management papers, regulations on nature protection and individual areas, the presence of zones with special conditions of purpose, territory and general purpose land, red lines, location of cordons , structures on the site - built and unfinished.

Who approves the layout?

Confirmation of the facility location plan is based on the decision. It states:

  • its size, which coincides with the data of the register drawing;
  • location of the allotment, registration number, description of the territory on which the object is located, category of land on which the allotment is located.

Required papers: application, extract from the Unified State Register of Legal Entities, drawing in electronic or paper form, details of the land surveying plan, measurement data, extract from the Unified State Register of Ownership of any structure located on the site, design of the site with the structures located on it, confirmation from the Unified State Register of Legal Entities about the absence of other rights to the place and the buildings located on it, registration passport.

The scheme is approved by the Property Relations Committee. The application review period is 30 days.

Sample layout

The layout of the land plot on the cadastral plan of the territory is approved by the Ministry of Economic Development of Russia. According to the Land Code of the Russian Federation, approval of the drawing is not carried out in the territory for which the application of the survey drawing is approved. The form of the land layout scheme comes in two types - one or several plots and has some mandatory requirements.
