Certificate of presence/absence of real estate ownership: what is it and when is it needed?

If a person buys housing (receives it by inheritance or as a gift) and formalizes the transaction in accordance with all the rules of Russian legislation, then information about this transaction is stored in the Unified State Real Estate Register (USRN). In fact, a certificate of the presence or absence of real estate is an extract from the Unified State Register of Real Estate, which indicates information about real estate and a person’s ownership of it.

Such a document is issued in paper or electronic form. The completed form contains the date of issue and document number.

If a person does not have real estate, in key sections of the form you will see dashes and the phrases “No data available.”

In what cases will you need a certificate confirming that a person does not own housing:

  • if he plans to stand in line for free housing;
  • when applying for a mortgage, obtaining credits, loans;

Where is it issued?

Information about real estate of Russians is stored in the unified state real estate register - EGRN. There are two places where you can get a certificate of absence of real estate without any problems:

  • Rosreestr (extract can be ordered online on the department’s website);
  • MFC (MFC employees act as intermediaries, requesting information from Rosreestr).

Information about the possibility of obtaining a document using the State Services portal is incorrect. You will not be able to order this document this way.

Until 1998, documents confirming the availability of housing were received from the BTI (Bureau of Technical Inventory). Contacting this organization and looking for where to get a BTI certificate about the absence of property now makes no sense: from 1998 to the present, information on real estate transactions has been registered in Rosreestr.

How to measure an apartment BTI

It is not so important whether we are talking about measuring an apartment in a new building or on the secondary housing market, the procedure is carried out according to a certain scenario. The following features are taken into account:

  • calculations of the apartment area are carried out in accordance with Order of the Ministry of Economic Development of the Russian Federation (Ministry of Economic Development of Russia) dated September 30, 2011 N 531 Moscow;
  • BTI apartment measurements involve calculations rounded to the nearest tenth. Linear dimensions are rounded to 0.01 m;
  • when calculating the area of ​​a loggia, a coefficient of 0.5 is used, a coefficient of 0.3 is used for a balcony;
  • to carry out the most accurate measurements of an apartment in a new building or on the secondary housing market, specialists must measure each wall, check the diagonals of the room, after which the area is calculated;
  • When measuring rooms with complex layouts, the object is first divided into rectangular elements, the resulting areas are measured and added up.
  • Measurement drawings are made in a professional CAD environment (Autocad, Archicad), which allows you to calculate the areas of apartments of any complexity with 100% accuracy.

And one more point: initially, the measurement of an apartment in a new building should be carried out by the development company with the involvement of BTI or a Cadastral Engineer. Without this stage, the state commission simply will not accept the house. Any errors at the initial measurement stage may result in an overpayment under the DDU Agreement, subsequent overpayments of taxes, etc.

The problem is that, unfortunately, BTI or Cadastral Engineers often make mistakes when carrying out measurements, either specifically by agreement with the developer or due to inattention, since they carry out work in large volumes. Sometimes measurements are carried out inattentively, sometimes there are typos in documents, sometimes plans are drawn up based on just a couple of measured floors. There are often situations when, when drawing up Technical plans, BTI specialists are guided only by information from design drawings - this can also lead to inaccuracies in the documentation.

This is why experts recommend that before purchasing an apartment in a new building and completing the paperwork, order apartment measurement services from third-party companies - in this case, identified inaccuracies can be corrected, avoiding many problems in the future when performing any actions with real estate (during sale, redevelopment, etc. Further).

What documents will be needed

If you are applying for an extract for yourself, you will only need a basic set of documents. If you are registering for another person, prepare a power of attorney certified by a notary.

Basic documents for obtaining the service:

  • passport;
  • receipt of payment of state duty;
  • a completed application for the provision of services (if you apply through the MFC).

Additional documents:

  • marriage certificate (if the joint property of the spouses is verified);
  • if you changed your last name, first name or patronymic, provide documents confirming their change.

How to get it from the MFC

It is convenient to receive an extract from the MFC if there is no branch of Rosreestr in your locality.

How a certificate of absence of real estate in the MFC is issued, sequence of actions:

  1. Prepare your documents.
  2. Make an appointment in advance or come and take an electronic queue coupon.
  3. When it’s your turn, hand over the documents to the MFC employee and fill out the application form for the service.
  4. An MFC employee will check and accept the documents and give you a receipt stating that the documents have been received from you. The receipt will indicate the date when you can pick up the statement.
  5. Pick up your statement on the stated date and time.

This Agreement defines the conditions for the use by Users of materials and services of the site (hereinafter referred to as the “Site”) and the processing, storage and other use of information received by the Site Administration from its Users
1. General conditions

1. The use of materials and services of the Site is governed by the norms of the current legislation of the Russian Federation.

2. Obligations of the User

2. Use of Site materials without the consent of the copyright holders is not permitted (Article 1270 of the Civil Code of the Russian Federation).

3. When quoting materials from the Site, including protected copyright works, a link to the Site is required (clause 1 of Article 1274 of the Civil Code of the Russian Federation).

4. The user is warned that the Site Administration is not responsible for his visit and use of external resources, links to which may be contained on the site.

5. The User agrees that the Site Administration is not responsible and has no direct or indirect obligations to the User in connection with any possible or occurred losses or damages associated with any content of the Site, copyright registration and information about such registration, goods or services available on or received through external sites or resources or other contacts the User entered into using information posted on the Site or links to external resources.

6. The user accepts the provision that all materials and services of the Site or any part thereof may be accompanied by advertising. The User agrees that the Site Administration does not bear any responsibility and does not have any obligations in connection with such advertising.

3. Processing of the User’s personal data

1. With regard to all reported Personal Data, the User gives the Site Administration full consent to their processing and confirms that, by giving such consent, he acts freely, of his own free will and in his own interest. The User's consent to the processing of personal data is specific, informed and conscious.

2. The site administration guarantees the User that the processing and storage of his received Personal Data will be carried out in accordance with the provisions of the Federal Law of June 27, 2006 No. 152-FZ “On Personal Data”.

3. The User grants the Site the right to carry out the following actions with personal data: collection and accumulation; storage; clarification (update, change); usage; destruction; depersonalization.

4. The site administration guarantees to the User that it uses the Personal Data received from him exclusively for purposes limited to marketing, advertising, information purposes of the Site, for analysis and research of Site Users, as well as for the purpose of providing him with services directly located on the Site.

5. The user in accordance with paragraph 1 of Art. 18 of the Federal Law “On Advertising” gives the site Administration its consent to receive advertising messages via the specified contact information.

6. Withdrawal of consent to the processing of personal data can be carried out by sending the User a corresponding order in simple written form to the email address: [email protected]

4. Other conditions

1. The Site Administration is not responsible for the use (both lawful and unlawful) by third parties of information posted by the User on the Site, including its reproduction and distribution, carried out in all possible ways.

2. The user of the site is independently responsible if the rights and legitimate interests of third parties were violated when using the Site by the User.

3. All possible disputes arising from or related to this Agreement shall be resolved in accordance with the current legislation of the Russian Federation.

4. The information presented on the Site is not a public offer.

5. The site administration has the right, without prior notice to the User, to terminate and (or) block access to the Site if the User has violated this Agreement or the terms of use of the Site contained in other documents, as well as in the event of termination of the Site or due to a technical problem or problem.

6. The site administration is not responsible to the User or third parties for termination of access to the Site in the event of a violation by the User of any provision of this Agreement or other document containing the terms of use of the Site.

The User confirms that the text of this User Agreement is clear to him, he is familiar with all the clauses of this Agreement, unconditionally accepts them, and consents to the processing of Personal Data.

How to get it from Rosreestr online - step-by-step instructions

It is convenient to obtain information from Rosreestr on the official portal of the department by going to the page with the form for requesting information from the Unified State Register of Real Estate. This type of request will only be processed if you have a verified electronic signature.

Step 1. Go to the page for requesting information from the Unified State Register of Real Estate; a certificate confirming the absence of property of an individual is issued after filling out the electronic form. In the “Request Details” section, select a specific area or check the box “Across the entire territory of the Russian Federation.”

Please indicate the specific type of property or property. Indicate for what period the certificate should be issued (check the box “As of date” and mark the dates).

Provide information: Full name, date of birth, SNILS.

After this, select the form in which to provide the information. If you selected email, enter your email address.

If you require a document in paper form, select the “Paper document by mail” option in the “In form” drop-down list. Click on the “Go to applicant information” button.


Step 2. Fill in information about the applicant or applicant's representative. If you are submitting a request on your own behalf, please re-enter the information you provided in the previous step. Check the box “I agree to the transfer of personal data to Rosreestr.” After that, click on the “Go to documents attached to the request” button.

Step 3. At this step, the form is filled out by those who receive an extract by proxy. If you are completing it on your own behalf, skip this step by clicking on the “Proceed to data verification” button.

If a certificate of absence of ownership of residential premises is issued by power of attorney, click on the “Add” button. A form will open in which you must indicate the type of document, its name, series, number, and date of issue. Upload a scanned power of attorney file in tiff, jpg, gif or pdf format and an electronic digital signature file in sig format. After that, click on the “Save” button, return to step 3 of the form and click on the “Proceed to data verification” button.

Step 4. At this step, the data entered in the form, request details, and information about the document are checked.


Check information about the copyright holder and the applicant. If changes are required, click on the “Change attached documents” button. If everything is filled out correctly, click on the “Sign and send request” button.
