The law prescribes

Management organizations were obliged to maintain such a register on the basis of Federal Law No. 485-FZ of December 31, 2017. Part 3.1 appeared in Article 45 of the RF Housing Code, which contains requirements for the content of the register:

  • Last name, first name, patronymic, if the owner is an individual,
  • Legal entity – full name and state registration number;
  • Room number in the apartment building;
  • Information on the size of the owned shares in the right of common ownership of the common property of the owners of premises in the apartment building.

Where can I get a register of apartment building owners?

Under such an abbreviation is hidden a book of records of persons living in an apartment building. This list must be prepared both on paper and in electronic form.

The said certificate is proof that the specified person lives in the house of interest with full right. Only owners of apartments that are part of the specified apartment building are allowed to participate in general building meetings. And they are all indicated in the register, and without this list it is not possible to draw up minutes of the meeting.

Important! When compiling, you must ensure that the following data is included:

  • the exact number of residential and non-residential premises in the building,
  • Full names of persons owning apartments in the building,
  • the area of ​​each living space in the house,
  • Some apartments are in shared ownership. Therefore, in the certificate we indicate the size of the shares belonging to each co-owner,
  • Do not forget to indicate in the certificate the title documents with all the details that served as the reason that the current owner of the apartment received the rights to it.

It is also necessary to know that if the register of registration of owners was not attached to the minutes of the meeting of residents of the house, then the executed protocol has no legal force, since according to the law it will be considered incorrectly executed.

What is it needed for

Basically, this register is necessary for residents of apartment buildings if they gather for a general house meeting to solve the most pressing problem.

The reasons for such meetings of residents may be the following:

  • to resolve issues related to the operation of property belonging to the common house. For example, renting out areas of a house,
  • when choosing persons who, on behalf of all residents of the house, will enter into agreements for the maintenance of the common area of ​​the house,
  • when resolving issues related to home renovation,
  • making decisions regarding restrictions on the disposal of the plot of land on which the house is located.

What information does the registry contain?

  • Full name of the owners,
  • a list of apartments that make up the house, with their descriptions,
  • area of ​​all residential premises,
  • What kind of ownership does the apartment belong to? It can be joint, individual or shared,
  • what shares do apartment owners have in common property,
  • data from documents establishing title and serving as the basis for ownership of apartments,
  • how many votes does each apartment have and the significance of the data,
  • the number of residential and non-residential premises in the house.

Where to get it

Not everyone living in the house knows where, if necessary, they can obtain the much-needed register of owners. According to accepted rules, this document must be kept in the company that currently manages the property. So if you need a register, you need to apply for it to the HOA or management company.

If they do not have this document, then the company can send a request to Rosreestr. It is in this organization that all information about all property owners is stored.

Also, this request, in addition to the management company and the HOA, can also be sent by an initiative group of residents wishing to hold a meeting.

Is it possible to get it for free?

In case of a standard application, the registration of an extract through Rosreestr is carried out with the payment of a state fee. The amount of the payment depends on the status of the applicant. For example, ordinary citizens must pay from 100 to 2000 rubles.

But if you don’t want to pay, then the required information can be submitted for free; this is done by requesting through the official website of Rosreestr - rosreestr.ru.

Time frame for registering owners and cost

If the management company sends a request, then it faces the next task - to notify the applicant in what time frame everything requested will be completed. We inform you that Rosreestr issues certificates for apartment owners within three working days. If the request is sent through the MFC, then the period naturally increases. But according to the law, no more than 1-2 days.

Typically, refusals to provide information are rare. Rosreestr issues extracts from the Unified State Register to almost everyone who wants them for a small fee (state fee). Individuals are asked to pay three hundred rubles.

If the request is sent by a legal entity, then the state fee will be slightly higher than 600. And this is only for statements issued electronically. If the registration is carried out on paper, then you will have to pay even more - 750 rubles for an individual and 2200 for a legal entity.

Typically, employees of management companies ask apartment owners to bring copies of the specified extracts from the Unified State Register of Real Estate, which are received by the owners after the transfer of ownership of the apartment has been completed. Thus, they avoid unnecessary expenses.

As you can see, everything is simple and reliable. Indeed, in this case, information confirmed by a federal organization will be placed before the company’s eyes. But an oral survey of people living in the house will not provide such reliable information. In addition, the survey will not cover everyone living in the house.

Whose hands does the register fall into?

Now such a register is provided to any initiator of the general meeting of owners of apartment buildings (Part 3.1 of Article 45 of the Housing Code of the Russian Federation) within five days after submitting an application. The consent of other owners to provide a register with their personal data for the purpose of convening and organizing a general meeting is not required.

Future owners have the right to participate in general meetings of premises owners. According to Part 1.1 of Art. 44 of the Housing Code of the Russian Federation, those persons who have not yet registered their premises in Rosreestr can also take part in general meetings of owners of premises in apartment buildings and vote on the agenda of the general meeting. By virtue of the Decree of the Government of the Russian Federation dated September 13, 2018 No. 1090 “On amendments to certain acts of the Government of the Russian Federation on the management of apartment buildings,” which entered into force on September 26, 2018, maintaining a register of owners is a licensing requirement for carrying out activities related to the management of apartment buildings. Lists of owners of premises in apartment buildings must be maintained exclusively in electronic form.

What is the register of owners of apartment buildings

The register of owners of an apartment building is a special book that records all the people who own apartments located in the building that has aroused interest.
Interestingly, the list of data can be obtained both on paper and in electronic format. This document is used as significant evidence that a person has the right to live in this house. In addition, only owners of apartments that are part of a given multi-story building can participate in general building meetings. Therefore, drawing up minutes of such meetings is impossible without using the register of owners.

Why and who needs a list of residents of an apartment building (MKD)?

By order of the Ministry of Construction No. 937, the register of residential buildings must be completed in order to hold a meeting of residents. If the list is not attached to the official minutes of the meeting, the decisions of the meeting may be considered invalid.

The document is needed not only to identify all homeowners in the house. This list is also necessary to find out the share of each owner, and therefore the significance of his vote.

The fact is that the counting of votes at a housing meeting is not carried out “individually”, but taking into account the share in the common property. For example, the owner of three apartments in an apartment building has more votes than the owner of one premises. In practice, going around to all residents and asking to show papers for real estate is problematic, which is why it was decided to use a single list, which helps to correctly distribute votes.

The document must be with the initiator who is organizing the meeting, wants to make a proposal to the residents, etc. After voting, the list is attached to the minutes.

Any individual, as well as a management company (MC), housing cooperative or HOA, can order the document. Each house must have a separate register.

Where is the current register stored?

The register of owners is included in the documents for managing apartment buildings, which responsible persons are required to keep up to date, store, accept and transfer in the manner prescribed by law, along with other documentation regarding apartment buildings. At the same time, from January 11, 2018, the management organization is obliged not only to maintain a register of owners of premises in apartment buildings, but also to provide this register at the request of the initiator of the general meeting of owners and return it after voting.
