    There are other special deadlines for accepting an inheritance:

  • A special period is established when a citizen is declared dead and the day of his expected death is determined in court. It lasts 6 months and begins its course from the moment the court decision enters into force. declaring the death of a citizen and establishing the day of his death (paragraph 2, paragraph 1, article 1154 of the Civil Code).
  • A special deadline is established for filing by persons whose right to receive an inheritance arose due to the refusal of other heirs (Article 1157 of the Civil Code), including a directed refusal (Article 1158 of the Civil Code) or due to the removal of these heirs due to recognition of their unworthiness (Article 1117 of the Civil Code).   • A special deadline for filing a document is established for persons whose right to receive an inheritance arose as a result of non-acceptance by other heirs. According to paragraph 3 of Art. 1154 of the Civil Code, such persons can submit an application to the notary within a three-month period, after the end of the total six-month period provided for the heirs of paragraph 1 of Art. 1154 of the Civil Code, who did not accept the inheritance.
  • A special deadline for filing is also established for persons who have received the right to inheritance through hereditary transmission (Article 1156 of the Civil Code). In this case, the transmitter can submit an application to the notary within the period provided for the transmitter and remaining after his death. If such period is less than three months, it must be extended to them.
  • If the deadline has been missed, it can be restored in court. subject to valid reasons for absence (clause 1 of Article 1155 of the Civil Code). In addition, conciliation is allowed. however, it requires the written consent of all other heirs who have managed to exercise their right (clause 2 of Article 1155 of the Civil Code).

    Citizen S, being the legal successor of her recognized deceased sister, submitted an application to the notary to issue her a certificate of inheritance after the deadline for its acceptance had expired (Article 1154 of the Civil Code). S cited her illness as the reason for missing the deadline. The notary explained to her that, according to Art. 1155 of the Civil Code, C has the right to restore the deadline - for this she needs to either obtain the consent of all other successors, or justify the valid reasons for missing the deadline in court.

    Since most of the other successors refused to restore S’s term, she had to go to court to do this. However, in the trial, citing a missed deadline for filing an application due to illness, S was unable to provide any evidence of undergoing treatment, which is why her demands to restore the deadline for filing an application were denied.

    Place of application

    A certificate of the right to inheritance is issued exclusively at the place of opening of the inheritance (clause 1 of Article 1162 of the Civil Code). Based on this and in accordance with paragraph 1 of Art. 1153 of the Civil Code, the application of a potential heir for the issuance of a certificate of his corresponding right is submitted exclusively at the place of opening of the inheritance. According to the general rule established by paragraph 1 of Art. 1115 of the Civil Code, such a place is considered to be the last official place of residence of the deceased citizen.

    According to Art. 20 of the Civil Code, the last place of residence of a citizen is considered to be the address at which he permanently or primarily resided until the moment of his actual death or he was declared dead in court.

    When submitting documents to a notary. operating in the district at such last place of residence, the heir will need to prove the correctness of determining the place of opening of the inheritance. According to paragraph 30 of the Methodological Recommendations for performing certain types of notarial acts, this can be done by providing certificates. issued at the place of permanent registration of the deceased by internal affairs bodies or housing maintenance organizations.

    However, if such last place of residence is unknown, then:

  • The application is submitted to a notary operating in the place where the inherited property of the deceased testator is located (clause 2 of Article 1115 of the Civil Code). It also requires documentary confirmation by providing title documents, extracts from the Unified State Register, purchase and sale agreements, etc.
  • In cases where the specified property is located in several places, the application is submitted to the notary at the location of the real estate. and if there are several such places, according to the place where the most valuable of them is located. In the absence of real estate, submission is made to the notary at the location of the most valuable part of the movable property (clause 1 of Article 1115 of the Civil Code). The determination of value is based on objective market value. which can only be determined by an appraiser.
  • In cases where the location of the property is unknown, the place of opening of the inheritance is determined by a court decision (Article 264 of the Code of Civil Procedure).
  • Drawing up an application for a certificate of inheritance

    The document submitted to the notary must contain the following information:

    1. information about the notary to whom the document is submitted
    2. passport details of the applicant and testator
    3. grounds of inheritance
    4. last place of residence and date of death of the testator
    5. information about the composition of the inheritance, indicating the location of the property, if known to the applicant
    6. expression of the will of the applicant aimed at accepting the inheritance
    7. information about other heirs known to the applicant.

    According to paragraph 1 of Art. 1153 of the Civil Code, the legislator provides 4 ways to submit an application to a notary for a certificate of inheritance rights - in person, by mail, by another person or through a representative.

    It is necessary to take into account some features of this procedure, in particular:

  • Persons with full legal capacity (Article 21, Article 27 of the Civil Code) or limited in legal capacity can submit documents independently, but only with the consent of their legal representatives (Article 26, Article 30 of the Civil Code). When submitting a document independently, the applicant must confirm his identity. This is done by providing the notary with a passport or any other such documents.
  • If a document is sent to a notary by post, the authenticity of the applicant’s signature must be certified by a notary or other authorized official (clause 1 of Article 1153 of the Civil Code). If it is sent by mail, the application is considered submitted from the moment it is handed over to the post office operator. Thus, the deadline for filing an application by mail is considered the last day for accepting the inheritance, even if it reaches the notary after the specified period.
  • According to paragraph 1 of Art. 1153 of the Civil Code, the legislator allows the filing not only by the applicant himself, but also by another person at his request. It is noteworthy that, according to clause 24 of the Methodological Recommendations for the registration of inheritance rights, for the actual transfer of the specified application at the request of the applicant, such another person does not require any special authority. In this case, the authenticity of the applicant’s signature is also subject to certification by a notary or other authorized person.

    How and to whom is an application for acceptance of inheritance submitted?

    A statement of intention to enter into an inheritance is submitted to the notary's office located at the place of residence of the deceased or to the representative office where the will was drawn up. It is allowed to submit at the location of the inherited property (if the registration address of the testator is unknown). In cases where there are several heritage objects, you can send an application to the notary’s office located at the location of the property whose value is the highest. In some situations, only the court can decide where to file the petition.

    • By mail;
    • Through a legal representative.

    If the application is submitted without the personal presence of the applicant, the execution of permits and title documents, as well as notarization, is required.

    Application for acceptance of inheritance

    An application for acceptance of inheritance serves as conclusive evidence of the heir’s intentions to become the owner of the inherited property. It is submitted either directly to the notary who is assigned to the house where the testator lived, or sent by registered mail with acknowledgment of delivery; then the day of application will be the date of mailing.

    The application indicates the last name, first name, patronymic and address of the applicant, the date of opening of the inheritance, the address of the testator and expresses the will of the applicant to accept the inheritance.

    The authenticity of the heir's signature on the application for acceptance of the inheritance must be notarized (or by another official authorized to perform notarial acts in accordance with paragraph 7 of Article 1125 of the Civil Code, or by another person authorized to certify powers of attorney in accordance with paragraph 3 of Article 185 of the Civil Code), except in cases when the heir personally came to the notary at the place where the inheritance was opened and submitted an application. In this case, the notary is obliged to accept the application even if the heir’s signature is not certified, and invite the heir to send a properly completed application or to appear in person before the notary.

    When registering an inheritance under a will, the heirs provide all the documents necessary to certify the place and time of opening of the inheritance, as well as to confirm the existence of inherited property. If the original will is lost, the heir, legatee or executor of the will has the right to apply to the notary who certified the will with an application for the issuance of a duplicate will. A copy of the death certificate is attached to such an application.

    When submitting an application to accept an inheritance, the heir is not required to provide the notary with evidence of the existence of the inheritance itself, kinship, dependency or marriage. And vice versa, when submitting an application for a certificate of inheritance, the heir submits to the notary all the necessary documents, since filing such an application entails legal consequences in conjunction with other legal facts (kinship, dependency).

    It is possible to accept an inheritance through a representative if the power of attorney specifically provides for the authority to accept the inheritance. A power of attorney is not required for the legal representative to accept an inheritance. In practice, the most common way of accepting an inheritance is the actual entry of the heir into possession of the inherited property. The actual acceptance of the inheritance is proven by documents (for example, bills for repairs), testimony, or in court.

    When inheriting real estate in the residential sector, situations are possible when the testator, during his lifetime, did not register the property that belonged to him in the Bureau of Technical Inventory and did not register his property right in the relevant registration chamber, which gives the notary the right to refuse to issue a certificate of inheritance. Similar situations may arise in relation to a land plot, which must be registered with the relevant land committee. The notary's refusal can be appealed in court.

    Submission deadline

    The period within which an application for acceptance of inheritance rights can be submitted is a six-month period. The countdown date for this time is considered to be:

    • Day of death of the testator;
    • The day the court ruling declaring someone dead or missing comes into force;

    There are exceptions for some situations. If a citizen was not notified of the emergence of inheritance rights within six months, he can subsequently restore the opportunity to receive an inheritance through the court. When hereditary powers are transferred in order of priority, a new six-month period is counted for each group of heirs.
