Purpose of payment

In addition to information about the volume, tariffs, payments for housing and communal services, the receipt includes voluntary home insurance. The utility consumer independently decides whether he will pay for property insurance. The insurance contract is valid if the monthly premiums indicated in the receipt have been paid.

For owners and tenants, paying for insurance is convenient:

Voluntary apartment insurance

Voluntary insurance of household property depends on the personal desire of the owner.

The municipal program is not mandatory.

In Moscow, the Program is implemented through the City Housing Insurance Center (GKU “Housing Insurance Center”).

The center holds a competition to select an insurer and carries out organizational insurance procedures (inclusion of the contribution into the Unified Payment Document - a single payment document), publication of information literature, etc.

The essence of the program is that, for a low, affordable price, the insurance company and the city budget undertake the obligation to pay the owner an insured amount in the amount of damage upon the occurrence of an insured event.

Payment proportions: insurer - 85%, budget money - 15%.

The program is preferential. This is expressed as follows:

  1. Insurance premium installment for 12 months. According to classic programs, installments of no more than 4 installments are allowed.
  2. No increasing installment coefficient;
  3. Low insurance premium (the rate is 0.05% of the insured amount, or 19.44 rubles).

Such rates are significantly lower than those at which Insurers sell other home insurance products. For comparison, usually the rate for this type of insurance is 10 times higher - about 0.7% - an order of magnitude higher.

In the municipal program, the homeowner pays the insurance premium in installments for 12 months along with utility bills without increasing the cost.

Insurance is carried out without inspection, in the form of an offer - an open offer, which you agree to by paying the first insurance premium.

Object of insurance

Compensation for damage is paid for damage and loss of property. An insured event can occur both inside and outside the insured property.

Insured events include:

  • fires - flames, heat or smoke;
  • explosions other than terrorism;
  • accidents on sewerage, water supply, heating networks;
  • natural disasters, lightning strikes.

Fully insured:

  • structural elements of housing - doors, windows, floors, walls, ceilings;
  • finishing elements;
  • internal communications and engineering equipment.

Damage from leaks through:

  • roofing;
  • seams between panels.

To conclude individual contracts, you must come to the insurer in person. It is allowed to additionally insure:

  1. Expensive real estate at a commercial rate.
  2. Risks.
  3. Communal apartments have common areas.

What risks does insurance cover?

The following will be recognized as insured events:

  • flooding of the apartment, if this did not occur as a result of leakage from the roof or through the seams between the panels;
  • damage to the apartment as a result of a natural disaster (hurricane, storm, etc.);
  • an explosion that did not occur as a result of a terrorist attack;
  • gas explosion in the insured or any other apartment;
  • a fire that started inside and outside the apartment.

Documentation

The insurance program was created on the basis of documents:

  1. Civil Code of the Russian Federation, “Insurance”, Ch. 48.
  2. On the organization of insurance business, Law No. 4015-1 of November 27, 1992.
  3. Housing Code of Russia, Art. 2.

An open competition is held among insurers. The winning companies send tenants and owners certificates of voluntary insurance of residential premises. These are public offers for 1 year, providing for monthly payment of fees.

In addition to insurers, the Moscow government is responsible for the voluntary home insurance program:

  • in case of damage to real estate - additional compensation for damage;
  • if destroyed, guarantees the provision of new housing.

What is this service

Russian citizens have the opportunity to voluntarily insure their property. Several years ago, a voluntary real estate insurance program was introduced.

Almost every person knows what voluntary insurance is. Insurance allows a person not to be left without housing if unforeseen circumstances arise that result in the building being destroyed or damaged.

Thus, a citizen who owns property can contact any insurance company (IC) that has permission to carry out such activities. The parties enter into an agreement according to which the insurer will be obliged to make an insurance payment upon the occurrence of an insured event. The procedure for carrying out the procedure and fulfilling obligations is regulated by Article 21 of the Housing Law[1] and the Law of the Russian Federation No. 4015-1 “On the organization of the insurance business in the Russian Federation”[2].

The subject of the contract is mainly: an apartment or other housing, a vehicle and life. A person who insures his apartment or house is obliged to make monthly contributions to the company.

Housing and communal services employees can become an intermediary between the owner and the company, in which case a preferential insurance agreement is created. For this reason, a new column appears on the receipt, without the owner’s permission. In this case, the payer has the right to refuse the service by simply ceasing to pay the fee. Or he can confirm his will and make monthly contributions.

Late payment will result in suspension of the agreement. And if a critical situation occurs, the insurance company will be released from all its obligations. Therefore, it is better to transfer money every month, without skipping.

Rates

Under the insurance program using EPD, city authorities set the insured value of one square meter of housing, which may change annually. The Moscow mayor's website above reports that it is equal to 42 thousand rubles in 2020. The insured value of residential property is calculated as the cost of one square meter multiplied by the total area.

For one square meter, the annual insurance premium is set at 22.44 rubles, which is 1.87 rubles monthly. The insurance premium is the product of the premium per 1 square meter and the total area of ​​the housing.

Example 1

Let's calculate the insured cost of an apartment with an area of ​​52 square meters: 42,000 * 52 = 2,184,000 rubles.

Example 2

The insurance premium (annual premium) for real estate from the previous example is equal to 22.44 * 52 = 1,166.88 rubles. Monthly payment indicated on the receipt: 1.87 * 52 = 97.24 rubles.

Transfer of contributions

If you have decided to pay insurance premiums, put o. Payment for insurance is indicated separately in payment documents. How to opt out of insurance

If the owner does not see the need to insure his apartment, he may not pay the monthly insurance premium. This choice can be made for any method of paying for utilities. According to Article 935 of the Civil Code of the Russian Federation, such services are provided exclusively on a voluntary basis.

Citizens who have already paid for the service, but wish to terminate it, can contact the insurance company with a corresponding application. The document must state the desire to terminate the contract with the office early.

Normative base

Voluntary regional home insurance against emergencies was introduced in the Russian Federation with the adoption of Federal Law No. 320-FZ dated August 3, 2018 “On Amendments to Certain Legislative Acts of the Russian Federation.” It was published on the legal information portal on August 3 and, according to the condition specified in the text, comes into force one year after publication, that is, at the beginning of August 2020.

The true meaning of the law is often distorted; it is important to understand the key rule contained in it - home insurance has been and remains voluntary. That is, whether to pay for this column on the receipt or not is the owner’s right, his choice, and not his responsibility.

However, this area is already regulated by Chapter 48 of the Civil Code of the Russian Federation. Why then was a special law needed: we will answer this question and at the same time explain what voluntary insurance provides.

The adjustments made to the legislation by 320-FZ regulate the procedure for compensation for damage to citizens whose housing was damaged by the consequences of emergency situations. Now, if you have insurance, damage will be paid from three sources:

  • federal budget;
  • regional budget;
  • at the expense of the insurance company.

The authorities of the subject will develop and approve insurance implementation programs on their own, while the amount of insurance amounts will be regulated by the government.

It is understood that contracts will be concluded for a period of 1 year, the payer will be able to make contributions along with the payment for utility services, which is why such a column will appear soon, and in some regions it has already appeared in receipts.

The methodology for calculating insurance rates will be developed by the Central Bank, i.e. the state will be directly involved in this process. A unified state automated residential insurance system is being created.

However, with insurance, there are more advantages for owners, according to a number of officials and officials:

  • if there is unoccupied new housing in the housing stock of the subject, then it can be provided to those who lost their shelter due to emergency situations;
  • if there are no available properties, cash payments will be made. The calculation of amounts takes into account the characteristics and market prices in the region;
  • at the initial stages of the program, the maximum insurance amount will be 300 - 500 thousand rubles, in the future they plan to increase it;
  • The monthly fee for voluntary home insurance, according to preliminary estimates, will be approximately 150 rubles. It will depend on the region, footage, existing risks, and other features;
  • such insurance will cover the risks of damage and destruction of the home during natural disasters (tsunami, earthquake, flood, etc.), as well as domestic disasters (for example, fire, flooding, but this will be determined by the authorities of a particular region);
  • in addition, the constituent entities may provide local benefits for such insurance (for low-income citizens and other groups of persons).

To assess damage and make decisions on the assignment of payments, special expert commissions will be created, which will include representatives of administrations and insurers. Which insurance company will become a participant in these new legal relations will also be decided at the subject level.

The All-Russian Union of Insurers reports that it is they who are developing the standard and uniform rules for home insurance so that the interests of citizens are protected from the very beginning, so that apartment owners immediately receive comprehensive information about insurance. Then they will be able to make an informed decision: to insure their home or exercise the right of refusal.

Is it possible to get the insurance back if the loan is repaid early?

It should be noted that voluntary home insurance for residents of the Russian Federation is not new. In a number of regions, such programs (under the name “social” insurance) were launched before the adoption of the law. There is successful experience in Moscow, the Moscow region, St. Petersburg, Krasnodar and other regions. In the capital, the period of application of this type of insurance has already reached 20 years, and from 10% of the population involved, the volume has increased to 60%.

But not everyone is interested and not everyone wants to see voluntary insurance in the housing and communal services receipt. Where can I apply for a waiver if the owner does not want to agree to insurance and pay monthly premiums?

We repeat: voluntary home insurance is not a mandatory payment. You can simply ignore this column on the receipt, reducing the total payment amount.

You need to contact the management company and thoroughly study all the nuances of the proposed insurance contract and obtain information about the insurance company. If the conditions do not meet the interests of the owner, he can enter into an agreement to insure his property with any other company.

Important: if several premiums have already been paid for insurance (for example, sometimes people pay automatically without checking the expense items), you should contact the insurance company with an application for early termination of the contract. And to the Criminal Code with a statement of refusal to participate in the voluntary insurance program. At the same time, you can ask to exclude this item from the payment document.

Payment of compensation

If an insured event occurs:

  1. Urgently contact the on-duty services - fire, emergency, dispatch.
  2. Notify the insurer by phone within 3 business days.
  3. Provide the documents requested by the insurer:
  • identification (passport);
  • written statement;
  • confirming property rights to real estate;
  • confirming the insured event;
  • certificate of voluntary home insurance;
  • on payment of insurance premiums.

After studying the documents provided, insurers assess the damage. The calculation is carried out according to the methodology of the MoszhilNIIproekt Institute, created in 2005. The amount of compensation is determined after calculating the ratio of the cost of damage to the insured value of the apartment. Money is paid within a week after the end of the settlement.
