In the last article we touched on the topic of cleaning ears with cotton swabs. It turned out that, despite the prevalence of such a procedure, self-cleaning of the ears can lead to perforation (rupture) of the eardrum and a significant decrease in hearing, up to complete deafness. However, improper ear cleaning is not the only thing that can damage our hearing. Excessive noise that exceeds sanitary standards, as well as barotrauma (injuries associated with pressure changes) can also lead to hearing loss.

To have an idea of the danger that noise poses to hearing, it is necessary to familiarize yourself with the permissible noise standards for different times of the day, as well as find out what noise level in decibels certain sounds produce. In this way, you can begin to understand what is safe for your hearing and what is dangerous. And with understanding comes the ability to avoid the harmful effects of sound on hearing.

Noise level in decibels (dB)

Indeed, the normal noise level is often significantly exceeded. Here are examples of just some of the sounds we encounter in our lives and how many decibels (dB) these sounds actually contain:

  • Spoken speech ranges from 45 decibels (dB) to 60 decibels (dB) , depending on the volume of the voice;
  • Car horn reaches 120 decibels (dB);
  • Heavy traffic noise – up to 80 decibels (dB);
  • Baby crying – 80 decibels (dB);
  • Operation noise of various office equipment, vacuum cleaner - 80 decibels (dB);
  • Noise of a running motorcycle, train - 90 decibels (dB);
  • The sound of dance music in a nightclub is 110 decibels (dB));
  • Airplane noise - 140 decibels (dB);
  • Noise from repair work – up to 100 decibels (dB);
  • Cooking on a stove - 40 decibels (dB);
  • Forest noise from 10 to 24 decibels (dB);
  • Lethal noise level for humans, explosion sound - 200 decibels (dB)).

As you can see, most of the noises that we encounter literally every day significantly exceed the permissible threshold. And these are just natural noises that we cannot do anything about. But there is also noise from TV and loud music, to which we expose our hearing aids. And with our own hands we cause enormous harm to our hearing.

The law states that people have the right to make noise in their apartments at strictly designated times, depending primarily on the region of residence. Note! 42 dB is the maximum permissible noise level in an apartment at night. In the constituent entities of the Russian Federation, “night” time is different. Experts have found that in most regions of the country, silence should be observed from 22:00 to 7:00.

What happens to hearing when exposed to noise?

Aggressive and prolonged noise exposure to the hearing aid can lead to perforation (rupture) of the eardrum. The consequence of this is decreased hearing and, as an extreme case, complete deafness. And although perforation (rupture) of the eardrum is a reversible disease (i.e., the eardrum can recover), the recovery process is long and depends on the severity of the perforation. In any case, treatment of perforation of the eardrum is carried out under the supervision of a doctor, who chooses a treatment regimen after examination.

Why are the norms on noise levels in residential premises of apartment buildings established by law?

It has been proven that prolonged noise exposure above 100 dB leads to hearing loss. The expressions “deaf from the noise”, “eardrums burst” are not a common cliché, as many people think, but a possible injury.

The legislator regulates the permitted noise level in the apartment. The norm by law has a certain numerical maximum, mandatory for execution by all individuals, legal entities, officials, and organizations without exception. To avoid the temptation to ignore the requirements of the laws, serious administrative liability is provided for non-compliance, especially for enterprises.

Noise issues in residential premises are regulated by:

  1. The Constitution of the Russian Federation guarantees the right to inviolability of home.
  2. “Rules for the use of residential premises dated January 21, 2006” Paragraph 6 of the rules requires taking into account the interests of other residents in the premises or house.
  3. Federal Law No. 52 “On the sanitary and epidemiological welfare of the population” obliges to comply with the provisions of regulations and not take actions that infringe on the rights of other citizens to protect health and comfortable living conditions (Article 10).
  4. SanPiN 2.1.2.2645-10 “Sanitary and epidemiological requirements for living conditions in residential buildings and premises” regulates noise levels.

The Law on Silence in an Apartment Building 2020, as Federal Law No. 52 “On the Sanitary and Epidemiological Welfare of the Population” is popularly called, was adopted to ensure and protect the sanitary and epidemiological well-being of residents. To ensure the right of citizens to a harmless living environment that does not have a detrimental effect on health, legislators maximally regulated situations that arise in everyday life by legal norms.

They are designed to ensure the implementation of the interests of owners of apartment buildings.

The maximum permissible sound level in apartment buildings cannot be higher than 55 dB during the day and 45 dB at night.

In each region, local local government bodies adopt their own “Silence Laws”; such a right is granted by the legislator (Article 5.1 of Federal Law No. 52). Regional “Silence Laws” are developed taking into account the norms of federal law, government regulations, etc.

So, if SanPiN regulates night time in the interval from 23.00 to 7.00, the subjects of the Russian Federation have the right, based on local characteristics, to make adjustments and set their own intervals of day and night time: for example, from 22.00 to 8.00, from 19.00 to 9.00, or accept the proposed value.

How to prevent hearing loss?

Now that we know the causes of hearing impairment, we can easily say that if we avoid prolonged aggressive exposure to noise on the hearing aid, then this alone will be enough to prevent hearing impairment. However, it is necessary to give our ears a rest: be in silence, go to places where the noise level is reduced, do not listen to loud music, TV, etc. As a result, the more time we can spend in calm, relaxing places, the more we can restore our hearing, which will serve us faithfully for a long time.

What will be the violation of silence at night and during the day?

Federal law has established uniform indicators that cannot be violated in 2020. During the night, the noise level in the apartment should not be higher than 30 dBA, and during the day the norm can be increased to 40 dBA. Night and daytime limits are set by local laws. Night time in Moscow is considered to be the period from 22.00 to 6.00 am, in St. Petersburg - from 23.00 to 7.00.

A law calling on all Russians to maintain silence at night and during the day in accordance with GOST 2020 was adopted at the federal level. Specific daytime and nighttime indicators are established by regional laws and regulations. Each subject of the Russian Federation has its own restrictions and norms that determine the possibility of making noise on the territory of an apartment building.

Sanitary standards CH 2

According to the letter of the Federal Service for Surveillance in the Sphere of Consumer Rights Protection and Human Welfare dated February 10, 2020 N 09-2438-17-16, these Sanitary Standards apply to the extent that does not contradict SanPiN 2.2.4.3359-16 “Sanitary and Epidemiological Requirements for Physical factors in the workplace", approved and put into effect on January 1, 2020 by Resolution of the Chief State Sanitary Doctor of the Russian Federation dated June 21, 2020 N 81

GUARANTEE:

1.2. Sanitary standards are mandatory for all organizations and legal entities on the territory of the Russian Federation, regardless of their form of ownership, subordination and affiliation, and for individuals, regardless of citizenship.

  1. First, try to solve the problem peacefully by talking with the offender.
  2. If there is no effect from the peaceful resolution of the conflict on your part, then you will have to involve the relevant organizations that will help put the noise offender in his place. By the way, these include:
  • Police. Obliges to send a local police officer upon receipt of a complaint from citizens to resolve the problem.
  • Sanitary and epidemiological station. Responsible for timely monitoring of noise standards in populated areas and, at the request of citizens, undertakes to take measurements if there is a suspicion of a violation of the “noise” order.
  • Rospotrebnadzor. The functions of this government agency are similar to those of the sanitary and epidemiological station. The main difference between them is that Rospotrebnadzor works in situations where there is a violation on the part of “big” individuals or organizations, and also where many people suffer.
  1. First of all, you need to contact the police station at your place of residence. Often, at the verbal request of citizens, the district police officer conducts a conversation with the noise violator, at which point the problems with violating the “noise” order end. However, if violations of noise standards continue, then you should contact the police with an official statement filled out in the prescribed form. After which the body will begin to deal with the problem officially, with the connection of the previously mentioned sanitary and epidemiological station and Rostpotrebnadzor.

Given this nuance, it is important to understand that in order to accurately determine the permissible noise level specifically at your place of residence, you need to contact the local government authority and ask its employees about this.

Noise standards in the Russian Federation

However, there are a huge number of references in various legislative acts to this issue, which directly or indirectly regulate it (GOST 12.1.003-83, Decrees of the Government of the Russian Federation, SanPin 2.2.4/2.1.8.582-96, etc.). Moreover, according to the law, individual subjects of the Russian Federation have the right to establish their own noise standards in the territory under their control, which, by the way, is actively used in practice.

  1. Noisy work. This includes not only repairs, but also loading operations if they exceed the permissible noise level.
  2. TV. At night it is forbidden to watch TV with the volume turned up. This includes radios, stereos and tape recorders.
  3. Use of pyrotechnics. The exception is the night from December 31 to January 1.
  4. General noise. This includes musical instruments, shouting, stomping, whistling, and other noisy activities.
  • actions aimed at recovery after natural disasters and emergencies. This includes stopping crime. For example, if your car was broken into by intruders and the alarm system went off, this is not considered a breach of peace;
  • cultural events and official holidays.

Acceptable noise level

Not everyone is familiar with the Law on noise in apartments of 2020, so some irresponsible citizens start renovations or organize noisy parties at night. Neighbors usually tolerate it, or try to pacify noisy residents on their own. However, why reinvent the wheel?

Noise standards in residential buildings were determined by the legislation of the Russian Federation in 1999. Violation of these rules may result in liability. According to Federal Law No. 52 “On the sanitary and epidemiological welfare of the population,” noise with a sound intensity of more than 45 dB at night and 55 dB during the day is considered unacceptable. Here it is important to determine which time is considered night and which is daytime.

At what time does the law allow making noise in an apartment in 2020?

Such irritation often results in serious scandals or attempts to surreptitiously ruin the life of a person from whose house various noises are heard. But civilized people solve this problem more calmly, using exclusively legal methods.

Exceptions due to which it is possible to create noise in an apartment at any time of the day, including at night, are the elimination of accidents, emergencies, as well as the performance of work, which will result in ensuring the safety of the residents of the house. That is, if a building suddenly begins to collapse as a result of an earthquake, you are unlikely to be able to complain about the rescuers fixing this problem.

New Federal Law “On Silence” in Russia in 2020

Residents of the cultural capital of Russia will be forced by law to pay larger amounts. Thus, ordinary citizens will shell out from their pockets from 500 to 4 thousand rubles, while legal entities will pay up to 50 thousand rubles. If noisy neighbors continue to disturb the order, then the repeated fine will be even higher. It is about two times the minimum wage per month. In St. Petersburg, the minimum salary is almost 10 thousand rubles.

We recommend reading: Is it possible to register someone in an apartment without the consent of the second owner?

According to the law, catering establishments (cafes, restaurants, karaoke bars, etc.) cannot be opened in residential buildings. But in practice, it happens when the law is not fully observed. At the same time, the owners of such establishments are obliged to take measures to soundproof the premises. Even beauty salons located in apartment buildings can cause considerable trouble for neighbors without soundproofing. For example, the constant operation of a hair dryer and other noisy appliances.

Noise level in the apartment: standard in decibels day and night, description of the law on silence

If there is constantly increased background noise in the apartment, then the person will sleep restlessly and have problems sleeping. The consequence of this is a decrease in performance and cognitive activity, this is especially noticeable in children.

Why is loud noise dangerous?

According to Federal law, night time is the period from 23:00 to 7:00. It is during this time that noise of no more than 30 dB is acceptable. Short-term amplified sounds up to 45 dB are allowed. This does not mean that you cannot, for example, turn on a stereo or TV at night. This is permitted provided that the volume of such equipment at night does not exceed 30 dB.

In addition to representatives of Rospotrebnadzor, you can call employees of other special organizations that work independently. However, check in advance whether they have the required level of accreditation and whether they are members of an SRO.

In order for measurements to be taken as evidence that neighbors exceed sound standards, experts advise using a special sound level meter. This is equipment that operates using special technology and produces an average indicator, which will then be compared with acceptable standards.

How to take measurements so that there is evidence?

For example, if a sound level meter recorded that the noise level in an apartment is 55 decibels, then this is not a reason to contact the authority, since the indicators were exceeded by only the permissible 15 decibels. But if the noise level is already 56 decibels, then this is a direct violation of current legislation.

Notice! According to these standards, a noise level of more than 40 decibels cannot be created in an apartment building. If various types of tools (equipment) are used during repair work, the noise level of which during operation will exceed the specified norm, residents living in the neighborhood have the right to write a complaint against the offender, demanding that silence be maintained.

Residents who organized repair work are not allowed to create obstructions from construction materials (waste), since such actions make it difficult to move according to the evacuation plan (if a fire or other emergency occurs).

Violation of the permissible noise level: what to do

However, the need to check the noise level constantly appears - in an apartment building, sources of increased sound are a frequent occurrence. There are many reasons: noisy residents in the neighborhood through the wall or next to the house, or karaoke, bar, club and other entertainment events were organized in the house.

It turns out that even the daily leisure of some residents creates a hindrance for others. If such cases arise, and everything happens very loudly, then the admin may be charged against the violators. protocol with the subsequent holding of the guilty residents accountable for committing petty hooliganism.

Law on noise in apartment buildings in 2020

The Law on Noise, or the Law on Silence, is often called 52-FZ of March 30, 1999. If we turn to this federal law, we will see that it is a much more comprehensive law, which in principle regulates the sanitary and epidemiological well-being of Russians. The noise level is only one of the sanitary standards that this law enshrines.

Comfortable noise levels are enshrined in federal law. For a residential building, such as an apartment building, the norm is considered to be a noise level of 40 dB during the day and 30 dB at night. At the same time, during the day the noise can briefly increase to 55 dB, but at night 30 dB should not be exceeded.
