In accordance with the Housing Code of the Russian Federation, each person who has a residence permit is required to pay for the services consumed, as well as the maintenance of the building.

10.Maintenance and repair of in-house power supply systems.Includes minor repairs to distribution boards, replacement of electrical elements, correction of wiring irregularities, etc.

If no response is received, then you need to file an application with the prosecutor’s office or court, since fulfilling the entire list is the direct responsibility of the service company.

Effect of the decision regarding the amount

Rent is calculated in accordance with the norms of Decree No. 491 of the Government of Russia dated August 13, 2006. As for Decree No. 307 “Rules for the provision of utility services to citizens,” adopted in the same year, it is no longer valid as of July 2020.

According to the first resolution, the costs of repairing and maintaining a house are expressed in the following points:

Nuances of forming charges

The payment calculation system has certain nuances that are not always strictly taken into account due to certain factors. Therefore, the payroll may contain an error, and therefore the amount required to be paid may increase significantly.

  1. Cold water supply. The water supplied must be clean and free of germs or any chemical impurities. It should be available around the clock. The maximum permissible break is up to 8 hours per month and no more than 24 hours in case of an accident.
  2. Hot water supply. Not everyone gets this anymore. This water, in addition to the above requirements, must have a temperature from 65 degrees Celsius to 75 degrees. Small deviations from the norm are allowed.
  3. Sewerage. Housing must have a wastewater disposal system.
  4. Heating. In this case, the main factor is the air temperature in the apartment. It should be at least +18 degrees in the room and at least +15 at the entrance. During the heating season, heating may be turned off for no more than 24 hours per month.
  5. Gas supply. Not all houses are connected to domestic gas. But if housing is connected, then it is paid along with other utilities.
  6. Electricity. Interruptions in the supply of electricity lasting 2 hours for two sources and 24 hours for one are allowed.

List of municipal utilities and their characteristic features

These services do not apply to any individual apartments or private houses, but create comfortable conditions for the owners or owners of residential premises, and they are included in the rent.

Obligations of management companies and housing and communal services

All obligations listed in the contract must be fulfilled by the company so that the contract is not terminated and penalties are applied to the HOA.

What housing and communal services must you pay for: types

Rent is fixed in law and an exhaustive list of payments included in it is indicated in Article 154 of the Housing Code of the Russian Federation. According to it, the owner (owner, tenant, if provided for in the contract) is obliged, on general terms, to pay for the list of housing and communal services included in the rent :

  1. Cold water supply. The main requirements for cold water are safety from pathogens and unacceptable chemical impurities. Water supply (both cold and hot) must be constant; a break of more than 8 hours per month is unacceptable, and in case of emergency - more than 24 hours.
  2. Hot water supply . In addition to the above requirements, there are also temperature standards - from 65 to 75 degrees Celsius (SanPin 1.4.2496−09) with slight possible deviations.
  3. Water disposal (sewerage) . Housing must have a wastewater disposal system. Water supply and sanitation are regulated by Federal Law No. 416 of 07.12.11 “On water supply and sanitation”.
  4. Heat supply. This type of service is determined by the air temperature in the apartment or other room. It should not fall below +18 degrees (+15 for entrances) for ordinary rooms and +20 for corner rooms. The permissible shutdown time (during the heating season) is 24 hours per month.   5. Gasification. Household gas is not connected to all houses and apartments, but if the housing is connected to a unified system, then its payment is included in utilities, according to Federal Law No. 69 of 03.03.99 “On gas supply in the Russian Federation.”
  6. Electricity . Power outages should not last more than 2 hours for two sources and 24 hours for one source.
  7. Lighting of common areas.

How are utility bills calculated?

This is not as difficult to do as it seems.

The calculation will depend on whether you deign to install metering devices, for example, a water or gas meter.

Meter readings are taken and multiplied by the current tariff at the moment and that’s it. If there are none, the number of people living in the apartment is taken and multiplied by the consumption standard, and then the resulting value is multiplied by the tariff.

If there are meters

To make it clearer, let's look at an example. Let's say you have a separate water meter installed. Then the calculations are made as follows:

  1. You need to take readings from the device and determine how much water was consumed this month.
  2. Now you need to find out the water tariff. Let it be 29 rubles/m3.
  3. The last step is to multiply the amount of water consumed by the tariff, and the amount to be paid is obtained.

Standards per person

If the counter is not installed:

  1. Let's say there are 2 people in a family. You need to multiply two by the required standard, for example, it corresponds to 10 m3 per person, then 2 is multiplied by 10 and the result is 20.
  2. Now the resulting number (20) should be multiplied by the tariff, that is, 20 * 29 (tariff) = 580 rubles.

No one is registered, what then

This may disappoint some people, but you still need to pay, and failure to pay can result in a fine. If meters are not installed, the calculation will take place according to the norms for one person, and it does not matter whether he lives in the apartment or not. In this case, counters can help. If they are installed and according to their indications no one has used the resources, then you do not need to pay, but it should be taken into account that not all types of services have meters installed. Hence the conclusion: it is impossible to completely free yourself from paying utility bills.

How is rent calculated?

The owner is required to pay for utilities from the moment of purchase of the property.

A citizen becomes obligated to pay rent upon purchasing a home. The owner of the apartment enters into an agreement with the service provider (hot water and heating, cold water, electricity) and with the management company, which maintains the communal communications in proper condition.

In accordance with this, monthly receipts are sent to the owner. Their number depends on how the contracts are distributed between the owner of the property, the management company and resource suppliers. Some suppliers enter into contracts with the management company (electricity, cold water), others (hot water, major repairs, intercom) prefer to receive money personally from the owners.

Accrual by registered, resident or area

The most important question that worries homeowners is how the rent depends on the number of registered and living people. To calculate rent, there are average consumption standards, which are calculated per person. These include:

  • Garbage removal;
  • Drainage;
  • Hot and cold water (if there are no meters);
  • Electricity (if there are no meters);
  • Gas (if there are no meters).

Payment for intercom, landline telephone and radio is not included in the rent receipt and is made separately.

Legal regulation

The Housing Code of the Russian Federation obliges everyone who has a permanent residence permit in a house or apartment under certain conditions (ownership, rent, rent, etc.) to pay for consumed utilities, as well as the maintenance of the house.

General recommendations and wishes set out in the Housing Code of the Russian Federation are brought to the final version by local authorities and administrative self-government bodies individually, locally.

Tariffs and standards for the calculation and payment of utility services are determined in accordance with the decree of the Government of the Russian Federation dated May 6, 2011. However, for each individual service (water supply, gas supply, electricity, etc.) the unit cost is set individually.

The main responsibility of owners and tenants of residential premises is the obligation to pay for consumed housing and communal services on a monthly basis in full.

What factors influence

Dependence on the number of residents

All owners of residential premises, without exception, undertake to transfer funds to the account of the management organization for the consumption of utility services no later than the 10th day of each month following the reporting period. Authorized employees of housing companies from time to time compare the information provided in the subscriber log with the actual readings of the reading devices.

If the relevant information does not match, then this will most likely lead to excess costs and, accordingly, overpayments. In addition, the case may be referred to the competent courts for the imposition of a penalty in the amount of 1/300 of the key rate of the Central Bank of the Russian Federation for one day.

You need to pay utility bills depending on the amount of resources consumed. If the fact of use was not recorded in the meters, then payment is made based on existing standards.

It is worth noting that the amount of payment directly depends on the number of citizens living in the premises, if the individual devices on the basis of which accounting is carried out were not previously installed for the following categories of services:

  • supply of hot and cold water;
  • supply of electricity and gas;
  • heating supply.

It is important to remember that interested parties can install a drainage meter without any problems. All tariffs are determined by territorial energy commissions. In situations where the house has a common meter, the total fee will be determined based on the principle of dividing the square meters of the room.

Residents can directly influence the following:

  • carrying out major repairs in multi-apartment buildings;
  • distribution of amounts for the organization of lighting of entrances and staircases;
  • removal of waste from the premises.

If no one is registered

All housing and communal services are provided to residents by organizations that have various legal forms, for a fee.

The provision of these services is fully regulated by the following regulations:

  • Housing Code of the Russian Federation;
  • Code of Administrative Offenses of the Russian Federation and the Civil Code;
  • resolutions of the Government of the Russian Federation;
  • Rules for the provision of public services;
  • Constitution.

Basic legislation is usually amended through separate acts that establish payment regimes for different categories of the population. For example, most officials can use housing and communal services completely free of charge, which cannot be said about deputies of the State Duma and members of the Federation Council - they must pay for housing and communal services on the same basis as ordinary citizens.

In any case, the obligation to make payments arises from the moment of direct acquisition of ownership. This requirement cannot be changed, even if no one is registered in the apartment.

Payment is always made by a member of the HOA (Home Owners Association) or the responsible tenant. To draw up a contract, it is necessary to prepare certain documents in advance.

Reduced amount

Among the typical reasons for reducing the current amount of payments, the following are worth highlighting:

  • provision of services for the maintenance of a property in an improper manner - as an exception, cases where violations were caused by force majeure may be identified;
  • provision of services with short-term interruptions that violate the provision of the contract on the duration of the supply of resources;
  • refusal of regulatory organizations to equip premises with individual reading devices.

To confirm the fact of violation of the established procedure for providing the services in question, a special act must be drawn up. The reduction in value itself can only occur on the basis of a corresponding application.

The interested apartment owner must submit this document to the responsible employee of the housing organization. As for tenants of apartments under social agreements, they must submit the application to the direct landlord.

These software products are posted on the websites of government bodies of the constituent entities of the Russian Federation, which are entrusted with the functions of regulating the housing and communal services sector and tariff policy.

If no one is registered or living in the apartment

It is necessary to install metering devices in the apartment and make payments according to indications for water, sewerage, electricity and gas.

Lack of registration does not exempt you from making payments for the maintenance of housing - payment for cleaning the local area, garbage removal, garbage disposal. Heating fees are charged per sq.m. meters and does not depend on registration and residence at a given address .

The housing office may exempt the homeowner from partial payment for cleaning the entrance and removing garbage due to absence; to do this, you must contact the management company with an application.

Utilities are recalculated in accordance with the Decree of the Government of the Russian Federation dated May 23, 2006. No. 307 , subject to the absence of individual metering devices in the residential premises and the provision of documents confirming the absence of a citizen.

To recalculate charges for housing and communal services in the event of temporary absence of residents (more than 5 days), it is necessary to submit to the organization providing the relevant service an application with documents confirming the duration of absence:

  • Copy of travel document;
  • Certificate of completion of treatment in a hospital;
  • Certificate of temporary registration at the place of stay;
  • Travel documents and others.
