In accordance with the legislation of the Russian Federation, in a number of cases, citizens have the right to return part of the money they previously paid in the form of tax (personal income tax).
For this purpose, it is possible to issue a tax deduction. It represents an amount that reduces the amount of income on which tax is paid. When officially employed, the employer pays the tax authority 13% of the employee’s earnings.
Thus, the latter receives only 87% of his salary. It is the withheld 13% that can be returned through a tax deduction. In the case of real estate, this can be done in two ways (and simultaneously):
- 260,000 rubles from the purchased housing (regardless of whether you used your own money or credit).

Registration procedure
Using the state program is quite simple - you need to provide a standard package of documents to the credit institution that issued the mortgage loan:
- passport of a citizen of the Russian Federation;
- full loan agreement for an apartment or house;
- a certificate from the bank about the terms of repayment of the mortgage and the remaining amount of debt;
- certificate of income from work;
- an extract from the Unified State Register confirming the right to ownership of the collateral housing;
- an extract from the Unified State Register confirming the absence of other housing;
- if there is a co-borrower, his income certificate;
- a certificate from the pension fund confirming the lack of income of dependent persons;
- certificate from the pension fund about the amount of pension;
- agreement on shared participation (for new buildings);
- assessment of the value of collateral;
- certificate from the bank about the payment schedule;
Documentary evidence of the financial difficulties that have arisen will also be required:
- certificate of registration with the employment center, in case of unemployment;
- a certificate of wage reduction at the enterprise, with copies of orders to reduce wages;
- all kinds of extracts from hospital records if any illness prevents repayment of the debt.
All documents from the Unified State Register are issued on a paid basis. In case of refusal to provide a subsidy, the money will not be returned. It is worth studying the provisions on the assignment of assistance well in order to avoid unnecessary expenses.
In addition to the main types of documents required to be presented to credit institutions, additional certificates and statements may also be required. The standard processing time for an application is 10 working days from the date of submission.
It is worth remembering that each individual financial institution reserves the right to set deadlines in accordance with its internal regulations. If it is necessary to urgently prepare documents, it is possible to write a written application to the bank with a request to speed up the verification process.
Scheme of the program
The program participant chooses one of two state assistance schemes. The first option involves transferring the entire subsidy amount towards the mortgage. It is 10% of the total loan amount. It is possible to write off the principal debt on a mortgage up to 600 thousand rubles. Six hundred thousand will be received by the borrower who bought a home for 6 million rubles.
The second option allows you to reduce your monthly payment, but not by more than half. However, it will not be possible to reduce all payments. The borrower will be able to pay the reduced amount for no more than 18 months.
More than 85 banks are participating in the state program. These include non-credit organizations. The deadline for reviewing an application is set independently by each individual bank.
There are conditions regarding the loan that must be changed:
if the mortgage loan was issued in dollars or euros, at the time of assistance under the state program it must be converted into rubles.
The transfer rate is carried out according to the data of the Central Bank of the Russian Federation as of the current date. Funds cannot be converted at the bank's exchange rate;
if the loan was issued in a foreign currency, the interest rate should not exceed 12%, and if the loan was issued in rubles, then the rate is frozen at the moment the agreement on government assistance for the mortgage loan is concluded.
For example, when the borrower submitted documents, the rate was 8%, and it cannot be increased until the state transfers up to 10% of the principal repayment amount.
During the program, the bank cannot charge the borrower a commission or interest for carrying out transactions under the terms of the federal program.

Program participants
The categories are divided into several conditions that must be met simultaneously:
- over the last 3 months, the borrower’s income has decreased by 30% or more, or the average monthly salary of all family members is less than double the cost of living per family member;
- a housing loan is issued in the form of mortgage lending;
the total area of the apartment or house is no more than 45 sq.m., if the housing is one-room, 65 sq.m., if the housing is two-room, 85 sq.m. for housing with three or more rooms. The exception is large families. The maximum area of the room is not calculated for them;- an apartment or a house for which a mortgage is issued is the only housing of the family seeking help. But any family member can participate in the common shared ownership of another home, if it does not exceed 50% in the other house or apartment. At the same time, other housing should not be the subject of the borrower’s mortgage;
- the loan must have been open for more than 12 months at the time of applying for government assistance.
In addition, it is necessary that the citizen meets one of the following conditions:
- the person for whom the loan is issued has at least one minor child;
- the borrower is disabled or is raising a disabled child;
- the citizen is a combat veteran.
Many families will qualify for these conditions if their income has decreased over the past few months or if one of the family members has lost their job. The program will also be useful for large families.
As a rule, in their case it is always possible to receive an income per family member below the threshold value, since the level of the average salary in Russia does not cover the expenses of this category of citizens.
Documents for receiving government assistance
The borrower must apply for help with a package of documents to the bank where the mortgage loan was issued. The bank independently determines the package of documents used to receive assistance. The program is implemented by the Housing Mortgage Lending Agency, or AHML for short. It has the right to request confirmation from the bank that the borrower meets the terms of the program. - formalized consent to the processing of personal data of the citizen and, if necessary, members of his family;

- documents confirming the child’s disability, if necessary;
- certificates and copies of documents confirming a decrease in income over the last 3 months or certificates confirming the reduction/dismissal of an employee;
- loan agreement;
- extract from the Unified State Register of Rights to Real Estate and Transactions with It;
- loan payment schedule.
In each specific case, this list can be expanded. You may have to present a certificate of registration with the employment center, or a certificate of a combat veteran. It all depends on which category the citizen belongs to.
When filing a request for government assistance, it is important to remember that:
- participation in the program does not repay the loan in full, but only 10% of the principal amount of the mortgage loan;
- public funds do not go to pay fines, penalties and interest on the loan. However, the creditor, at its discretion, may partially allow their repayment;
- If the contract specifies the types of credit insurance, then participation in the program does not exempt you from insurance payments under the contract.

Only families who are participants in the federal program “Affordable Housing for Young Families” can apply to write off part of the mortgage at the birth of a baby.
Citizens who have taken out a classic mortgage are not granted this right.

The deadline for making a decision on an application is not established by Decree of the Government of the Russian Federation No. 373, therefore they are determined by the internal regulatory documents of the creditor. At Sberbank, the decision to revise the mortgage is made within 2-5 business days.
List of documents
In addition to the application to the bank, you must provide:
- borrower's passport;
- financial documents confirming the right to participate in the program (certificates of income of all family members 3 months before applying for a targeted housing loan and 3 months before applying to the bank for restructuring);
- a certified copy of the work record book or a copy of the employment contract;
- marriage registration certificate (or divorce document);
- child's birth certificate;
- documents for the mortgaged property (registration certificate, cadastral passport);

The borrower bears full responsibility for compliance with other conditions stipulated by the loan agreement (insurance of the property, personal insurance, etc.). Writing off part of the mortgage debt in the event of a decrease in income, the birth of a child, or young families is a good help for citizens in the current economic realities.
Write-off of mortgage principal
Debt may also increase due to crises in the economy and currency debt. Thus, borrowers who took out a mortgage in dollars, but receive salaries in rubles due to a sharp drop in the exchange rate, may be forced to pay almost all their earnings to pay.

- the borrower must be a citizen of the Russian Federation;
- the total income after repayment of the loan must be less than two subsistence minimums for the region where the debtor lives;

Initially, the project provided for the restructuring of a target loan only if there was a delay. The new version allows individuals who do not have overdue payments to apply for government assistance. All borrowers eligible for mortgage forgiveness must meet a household income requirement. The earlier version provided that in order to receive targeted government assistance, the average monthly household income for 3 months must decrease by 30% compared to the average monthly value for 12 months.
Restructuring of foreign currency mortgages under the program was possible with an increase in the regular payment by 30% compared to the value of September 2014. The income of co-borrowers was not taken into account in the calculations.
According to the new amendments
In accordance with the amendments made at the end of 2020, the algorithm for calculating household income has changed. To participate in the program, the family budget (all members, taking into account benefits and other income for minors) 3 months before applying for state assistance must be reduced by 30% compared to the total cash receipts 3 months before applying for a mortgage.
For a foreign currency mortgage, the regular payment should increase by 30% compared to the monthly payment on the date of registration of the mortgage. The balance of funds at the disposal of the family after making the next contribution should not exceed 2 subsistence minimums established in the constituent entity of the Russian Federation.
In addition, when calculating the total budget, the official income of co-borrowers is taken into account. AHML has repeatedly noted that co-borrowers must be responsible for the timely servicing of mortgage obligations.
Requirements for existing grounds for debt write-off
A change in family income or payments on a foreign currency loan is not enough to take part in the state assistance program for mortgage holders, which requires additional conditions to be met in terms of:
- social status of the applicant;
- ownership of other real estate;
- area of apartments purchased with a mortgage;
- period of time from the date of receipt of the loan.
Status aspect
The list of persons who have the opportunity to contact the creditor bank for mortgage restructuring is as follows:
- parents or guardians of more than one child under the age of majority;
- combatants with a veteran's certificate;
- persons with officially confirmed disabilities, as well as those with children with similar signs of limited legal capacity.
The changes made in December 2020 excluded a number of categories of citizens from those worthy of state support, namely:
- participants in social programs for state mortgage support;
- government employees and scientific workers;
- workers for the benefit of the country's defense potential.
Restriction of property rights
The initially imposed restriction was on an area of 18 square meters. meters in the mortgaged property, for each household member of the mortgagee’s family, in the current version it has been softened and now, having owned a single apartment, citizens can be co-owners of other real estate objects if their share does not exceed half the area.
Date of loan receipt
In the basic version of Resolution No. 373, only a borrower who was otherwise eligible and had entered into an agreement no later than January 1, 2020 could apply for state support. The current edition has made this parameter floating, limiting not the date of lending, but the period until applying for restructuring , which should occur no earlier than a year after signing the mortgage agreement.
To real estate
There are a number of restrictions that apply to real estate:
- The apartment must be of a certain size, which is determined by the number of rooms:
- 1 room – 45 sq.m;
- 2 rooms – 65 sq.m;
- 3 rooms – 85 sq.m.
- The apartment must be the only residence . Also, a participant may own no more than half the area of another home.
- Real estate should not be involved in legal "shenanigans" . That is, it should not be under an encumbrance, or undergo legal proceedings (read about the removal of encumbrance here).
- The cost per square meter should be the average for the area . Cannot exceed the average cost by more than 60%.
ATTENTION : If there are more than two minor children in a family, the square footage requirements do not apply.
Writing off the principal debt on a mortgage - the rules of the law
The legislation provides for a law that provides for the write-off of mortgage debt. We are talking about Government Resolution No. 373, effective from July 23, 2020. Subsequently, the law underwent several amendments, and in December the next edition was introduced, put into effect by the President of the Russian Federation (decree number 1331).
The essence of the program is to write off mortgage debt by 0.6 million rubles. It is also possible to change the lending currency (at the Central Bank exchange rate) or reduce regular payments for up to 1.5 years.
Help for combat veterans
Returning to whether there is a provision for writing off 20 percent of the mortgage for combat veterans, we can safely say - no, it is not provided. Those who participated in military conflicts on the territory of the Chechen Republic and adjacent territories from December 1994 to December 1996 or in counter-terrorism operations in the North Caucasus since August 1999 have much greater benefits.
Firstly, if a former serviceman is registered as a participant in hostilities before 2005 and needs improved living conditions, then he receives real estate in the shortest possible time. Secondly, if a veteran is evicted from a service apartment, he is also provided with new housing space free of charge. Thirdly, the state necessarily covers half of utility bills.
Another interesting point is the opportunity to get the necessary living space not with real estate, but with money. True, it is calculated that the apartment due to the veteran, the cost of which will be paid in cash, has an area of only 18 square meters, and the price per square meter is determined by the average for the given region. In addition, a veteran can receive a free plot of land, which he can use either to build his own home or to run a household - the costs of this will no longer be covered by the state.
And not for military personnel
Unfortunately, it is impossible to write off 20 percent of the mortgage for combat veterans at Sberbank; you will have to rely either on the state with all the benefits it provides to former military personnel, or on falling under the social housing program.
One of these options is issuing a mortgage loan subject to the government repaying some part of the loan. In this case, the initial contribution is paid by the borrower himself, and the state simply returns part of the amount for interest payments to his bank account. If a serviceman is a participant in the savings-mortgage system, then he is exempt from paying the first mortgage payment. In addition, the state will also cover part of the cost of paying interest on the loan.
Ways to write off mortgage debt
Based on the analysis of Government Decree No. 373 of the Russian Federation and other regulations, the following options for writing off or co-financing payments on principal and interest can be identified:
- for foreign currency mortgages - establishing in the agreement an exchange rate indicator lower than the current rate of the Central Bank of the Russian Federation; transfer of the principal amount into Russian currency at a preferential rate; exemption from paying part of the debt; reduction of the monthly payment by 50% for a period of up to one and a half years;
- for a ruble mortgage - repayment of part of the debt within the legal limit; restructuring with the establishment of a new payment schedule; reduction of the monthly payment by 50% for a period of up to one and a half years;
- tax deduction program - you can return part of the personal income tax paid at the place of employment for the entire amount of mortgage interest for the previous calendar year.

The procedure for confirming the conditions for state support measures is extremely labor-intensive. To eliminate the possibility of refusal, it is better to carry out all actions with the support of experienced specialists in the field of lending.
Several assistance measures may be used. For example, when allocating funds from the state budget or the AHML fund, the bank may enter into an agreement with the debtor to restructure monthly payments.
The following support measures are used for foreign currency borrowers:
- transferring the amount of debt from foreign currency into rubles, using the exchange rate difference below the current rate;
- use of a reduced interest rate after transferring the loan into rubles - no higher than 12% per annum;
- repayment of the principal debt in the amount of up to 600 thousand rubles, if due to exchange rate differences the monthly payment amount has increased by more than 30%;
- reducing the monthly payment by half for a period of up to one and a half years.
To implement these assistance options, a citizen must contact the banking institution that issued the loan. At the same time, he must document the conditions for using government support measures.
For citizens who received a loan in rubles, the federal program also provides for the possibility of repaying up to 10% of the balance of the principal debt, but not more than 600 thousand rubles. The key condition for receiving this support measure is a significant reduction in the average income for each family member.
Debt write-off at the birth of children occurs upon provision of a certificate from civil registry offices. Regional programs can set the amount of the principal debt, which will be repaid upon the birth of each subsequent child (for example, 25% for the first, 50% for the second, 100% for the third). In addition, a subject of the Russian Federation may introduce a maximum limit of funds that is allocated to one family.
Write-off of loan interest may be provided for in a debt restructuring agreement. Also, the Tax Code of the Russian Federation makes it possible to return part of the personal income tax under the following conditions:
- the entire amount of interest actually paid for the previous calendar year is subject to reimbursement;
- the amount is no more than 13% of the amount of personal income tax actually paid for the previous year;
- The tax deduction for mortgage interest has no deadline; you can apply for a refund in each year of the loan agreement.
Thus, the state makes it possible to significantly reduce the size of the loan balance, but full settlement with the bank is only possible under the program to support large families.
When interest cannot be returned
Since the tax deduction is directly related to the payment of personal income tax, there are also cases in which a refund of interest is impossible. In particular, interest on a mortgage loan will not be returned in the following cases:
- If a citizen is not officially employed, as a result of which personal income tax is not paid.
- If a person is temporarily unemployed or retired.
- An individual entrepreneur engaged in entrepreneurial activities under a special regime.
- The person previously received this interest deduction in full.
